Rendering automatic by computer that which is done by hand per se would have been obvious to one of ordinary skill in the art. See In re Rundell , 48 F.2d 958 ([CCPA 1931]) and Leapfrog Enterprises Inc. v. Fisher- Price Inc. , 485 F.3d 1157 (Fed. Cir. 2007).

“[A]n inventive concept can be found in the non-conventional and non generic arrangement of known, conventional pieces,” even if these pieces constitute generic computer-related components. Bascom Global Internet v. AT&T Mobility LLC , 827 F.3d 1341, 1350 (Fed. Cir. 2016). The instant claims are similar to those in Bascom in that as in Bascom, an intermediary is inserted between two otherwise conventional computer nodes to move the location where a process is otherwise ordinarily executed. In Bascom it was filtering and in the instant claims it is checking on credit use limitations. The reasons for moving are similar in both cases and are rooted in the ways of internet technology.

The use of “i.e.,” in the intrinsic record is often definitional. Edwards Lifesciences LLC v. Cook Inc., 582 F.3d 1322, 1334 (Fed. Cir. 2009) (“[U]se of ‘i.e.’ signals an intent to define the word to which it refers.”); see also Abbott Labs. v. Novopharm Ltd., 323 F.3d 1324, 1330 (Fed. Cir. 2003) (holding that a patentee “explicitly defined” a term by using “i.e.” followed by an explanatory phrase). Here, in describing the difference between detecting a primary stream for single or dual stream transmissions, the Specification provides that for the dual stream transmission, an extra term is utilized and “[t]his extra term is due to the inter-stream interference, i.e., Si [the primary stream] and S2 [the secondary stream] will interfere with each other.” Spec. 11:13—20. As such, the broadest reasonable interpretation of “inter-stream interference,” consistent with the Specification, is the interference caused by the transmission of one stream on another concurrently transmitted stream.

Given this broad disclosure, even if claim 1 did not foreclose certain combinations of cytokines and autoantibodies at present, the draftsperson may pursue these combinations through future claims, thus expanding the preemptive reach of Appellants’ invention drawn to the natural law.10 Cf. In re BRCA1- and BRCA2-Based Hereditary Cancer Test Patent Litig., 774 F.3d 755, 764 n. 4 (Fed. Cir. 2014) (“The preemptive nature of the claims is not ameliorated even if we accept Myriad’s argument that other methods of comparison exist. If the combination of certain routine steps were patent eligible, so too would different combinations of other routine steps.”)

Appellants first contend that one of ordinary skill in the art would understand that a thermally sprayed layer has a specific implied structure. Appeal Br. 10. Appellants support this contention with a declaration from Appellant Makoto Souwa stating that “one [of] ordinary skill in the art would understand, a thermally sprayed layer would have a structure that closely matches the unevenness and crevices of the underlying layer.” Id. at 11 (citing Souwa Decl. dated April 7, 2014,17). Appellants, relying on In re Garnero, 412 F. 2d 276, 279 (CCPA 1979), then argue that the implied structural characteristics of a thermally sprayed layer should be considered in the patentability analysis of a product by process claim.

Thus, we discern no reversible error in the Examiner’s assessment of the weight to be given to the submitted evidence. In re Am. Acad, of Sci. Tech Ctr., 367 F.3d 1359, 1368 (Fed. Appellants do not point to any distinction between the structure set forth in claim 1 and that of Hibner. A recitation with respect to the manner in which a claimed apparatus is intended to be employed, as is the limitation “wherein actuation of the motor drive assembly causes the inner tube to rotate at a speed of at least about 3000 rotations per minute, and to oscillate translationally at a rate of about 1.5 to about 4 cycles per second,” does not differentiate the claimed apparatus from a prior art apparatus satisfying the structural limitations claimed. See, e.g., In re Yanush, 477 F.2d 958, 959 (CCPA 1973) (“Appellant’s use limitation does not impart a structural feature different from those of the prior art. . . . Whether a vibrator is operated gently to settle materials in a mold or more forcefully to ‘hammer’ them is a process limitation which does not limit or define the claimed apparatus.”); In re Casey, 370 F.2d 576, 579—80 (CCPA 1967).

A device claim “cannot properly be allowed unless [it] include[s] structural limitations defining invention over the prior art.” In re Twomey, 218 F.2d 593, 596 (CCPA 1955).
