Nevertheless, as the Examiner points out, the claimed scheme is similar in character to the ranking of available therapeutic treatment regimens to guide the selection of a therapeutic treatment regimen covered by the claims at issue in SmartGene, Inc. v. Advanced Biological Labs., SA, 555 F. App'x 950 (Fed. Cir.), cert, denied, 135 S. Ct. 58, 190 L. Ed. 2d 32 (2014). We agree with Appellant. The broadest reasonable interpretation does not mean the broadest possible interpretation. See Microsoft Corp. v. Proxyconn, Inc., 789 F.3d 1292, 1298 (Fed. Cir. 2015) (stating that although claim terms must be given their broadest reasonable interpretation, the interpretation must still be reasonable). The claims do not recite “maintaining” a given throwback distance; rather the claim recites “adjustably maintaining” the throwback distance. The Examiner’s construction of “adjustably maintaining the throwback distance substantially constant” that covers a method where the throwback distance cannot be adjusted during printing would render the term “adjustably” superfluous and is unreasonable.  As such, because each of claims 1 and 21 recites that the claimed probe is configured for communication with an ultrasound console, the probe and the ultrasound console constitute separate elements and, therefore, the Examiner’s interpretation of Bartlett’s DPU 1 and probe 2 as constituting together the claimed “probe” is unreasonable. See Engel Indus., Inc. v. Lockformer Co., 96 F.3d 1398, 1404—05 (Fed. Cir. 1996) (construing separate claim terms as reciting separate structures).

Claim 1 recites three “unit[s]”, the name of each unit (e.g., “a vernacular pronunciation extracting unit”) corresponding to a function to be performed by the “unit” (e.g., “to extract a vernacular pronunciation in response to receipt of a Hanja character string”). These limitations do not include the word “means,” thus, a rebuttable presumption exists these limitations are not means-plus-function limitations. Williamson v. Citrix Online, LLC, 792 F.3d 1339, 1348 (Fed. Cir. 2015). This presumption can be overcome if the limitation “fails to recite sufficiently definite structure or else recites function without reciting sufficient structure for performing that function.” Id. at 1349 (citation and internal quotation marks omitted). Contrary to Appellants argument (Br. 6), the presumption is not a “strong” one.1 As used herein, the term “means for” is replaced by the “nonce  word”2 “unit” thereby connoting one or more generic “black boxes” for performing all of the intended functions recited in claim 1.

Instead, the word “unit” is merely a transition between a shortened description of a function to be performed (e.g., vernacular pronunciation extracting) and the corresponding full description of that function (e.g., apparatus “to extract a vernacular pronunciation in response to receipt of a Hanja character string”). Thus, as used in claim 1, the term “unit” is a “non-structural generic placeholder” that is tantamount to the term “means” because it fails to connote sufficiently definite structure (i.e., a “nonce word”). We agree with the Examiner that claim 1 is not patent-eligible subject matter. Claim 1 is directed to a peptide that is made up of a fragment of the naturally occurring matriptase protein. Thus, the Supreme Court opinion in Association for Molecular Pathology v. Myriad Genetics, Inc., 133 S.Ct. 2107 (2013), is controlling. In Myriad, the Court considered claims directed to isolated DNA encoding the BRCA1 polypeptide and fragments of at least 15 nucleotides of that DNA. Id. at 2113.

The Court held that “Myriad did not create anything. To be sure, it found an important and useful gene, but separating that gene from its surrounding genetic material is not an act of invention.” Id. at 2117. “Myriad found the location of the BRCA1 and BRCA2 genes, but that discovery, by itself, does not render the BRCA genes ‘new . . . composition[s] of matter,’ § 101, that are patent eligible.” Id. “Nor are Myriad’s claims saved by the fact that isolating DNA from the human genome severs chemical bonds and thereby creates a nonnaturally occurring molecule.” Id. at 2118.
