Reviewing paragraph 57 of the Specification, we find several examples of what is meant by the claimed "aspects of the conversation" set forth there. Such examples include "providing too much information," "asking unusual questions," and "business offers." We find these examples in paragraph 57 render the claimed limitation definite. Accordingly, we do not sustain the Examiner's rejection on this basis.

The Examiner should address the Office's prior position in the Restriction as compared with the Examiner's position on appeal that the pending claims are "not patentably distinct" from the patent claims cited in support of the double patenting rejections. See, e.g., Ans. 6, 8. Lastly, the Examiner should determine whether the claims remain in consonance. See Symbol Techs., Inc. v. Opticon, Inc., 935 F.2d 1569, 1579 (Fed. Cir. 1991) ("Consonance requires that the line of demarcation between the 'independent and distinct inventions' that prompted the restriction requirement be maintained .... The Examiner determines that "the limitations followed by the terms 'configured to' and 'adapted to' are not positively [re]cited limitations and not fully given patentable weight." Id. at 5 (we understand the Examiner to mean the limitations following the terms "configured to" and "adapted to"). Continuing, the Examiner determines that "the recitation that an element is 'adapted to' perform a function is not a positive limitation but only requires the ability to so perform" and "does not constitute a limitation in any patentable sense." Ans. 6 (citing In re Hutchison, 154 F.2d 135 (CCPA 1946)).

We further agree with Appellants that the Examiner has improperly failed to address the "configured to" and "adapted to" recitations of claim 1. See Appeal Br. 11-12. "[T]he phrase 'adapted to' generally means 'made to,' 'designed to,' or 'configured to,' though it can also be used more broadly to mean 'capable of or 'suitable for."' In re Man Mach. Interface Techs. LLC, 822 F.3d 1282, 1286 (Fed. Cir. 2016) (citing In re Giannelli, 739 F.3d 1375, 1379 (Fed. Cir. 2014)). In Giannelli, the court looked to the written description of the application and determined that the phrase "adapted to," in view of the specification, has a narrower meaning than "capable of' or "suited for." Giannelli, 739 F.3d at 1379; see also Aspex Eyewear, Inc. v. Marchan Eyewear, Inc., 672 F.3d 1335, 1349 (Fed. Cir. 2012) (holding that "adapted to" required elements to be "designed or configured to accomplish the specified objective, not simply that they can be made to serve that purpose"). In this case, we likewise look to Appellants' Specification to discern the meaning of "configured to" and "adapted to."

Instead, the Examiner cites Howard v. Detroit Stove Works, 150 U.S. 164, 170 (1893) for the per se rule that "forming in one piece an article which has formerly been formed in two pieces and put together involves only routine skill in the art." (Final Act. 4 & 5). In Detroit Stove Works, the Court held that it would have been obvious to cast a one-piece grate for a circular stove having the shape of a prior art grate that was cast in two pieces for use for burning coal. Id. at 169 & 170. Molding a foam plastic part so as to form a skin layer having desired properties different from those of the foam body beneath is both more complicated, and less predictable, than casting a metal grate as a unitary body. In view of this added complication and loss of predictability, we are not persuaded that the prior art practice of laminating a low-friction, polymeric film onto a foam body of a sports board would have suggested, per se, attempting to mold the outer foam layer in such a manner as to form a comparable skin layer. Although the Examiner represents in the "Response to Arguments" section of the Final Action that "forming the two pieces [ the outer foam layer and the film] of the prior art into one piece [ would have been] obvious to get predictable and expected results as set forth in the rejection" (see Final Act. 10), the Examiner does not direct us to where those predictable and expected results might be articulated.
