To establish obviousness under 35 U.S.C. § 103, one of ordinary skill in the art must have a reasonable expectation that the prior art, when combined, would succeed in making the claimed invention. "Conclusive proof of efficacy is not necessary to show obviousness." Accorda Therapeutics, Inc. v. Roxane Laboratories, Inc., 903 F.3d 1310, 1333 (Fed. Cir. 2018) (quoting from Hoffmann-La Roche Inc. v. Apotex Inc., 748 F.3d 1326, 1331 (Fed. Cir. 2014). "'Obviousness does not require absolute predictability of success ... all that is required is a reasonable expectation of success.' [citing In re O'Farrell, 853 F.2d 894, 903---04 (Fed. Cir. 1988)]." In re Kubin, 561 F.3d 1351, 1360 (Fed. Cir. 2009). However, "the evidentiary basis for an inference of reasonable expectation of success may be inadequate." Accorda, 903 F.3d at 1333-34.

Because the Examiner does not establish that the prior art recognizes the purported equivalency between Lemmer and Reymond - as is required by In re Ruff - the Examiner improperly relied on equivalence as a rationale for supporting an obviousness rejection. See In re Ruff, 256 F.2d 590, 596 (CCPA 1958) (substitution of one equivalent for another is obvious only where equivalency is known in the prior art). Frorn our perspective, the only suggestion for putting the selected disclosures of the references together in the manner proposed by the Examiner lays in the hindsight accorded one who first viewed Appellant's disclosure. This, of course, is not a proper basis for a rejection. See Sensonics Inc. v. Aerosonic Corp., 81 F.3d 1566, 1570 (Fed. Cir. 1996) ("The invention must be viewed not after the blueprint has been drawn by the inventor, but as it would have been perceived in the state of the art that existed at the time the invention was made." With respect to Appellant's first argument, we are unpersuaded that a terminal disclaimer should not be required because Appellant's claims, if allowed, would expire before those of the reference patents. An improper timewise extension is only one of the justifications for ODP doctrine. Another "rationale is to prevent multiple infringement suits by different assignees asserting essentially the same patented invention." In re Hubbell, 709 F.3d 1140, 1145 (Fed. Cir. 2013). For this reason, the Office's regulation requires that terminal disclaimers filed to obviate an ODP rejection include "a provision that any patent granted on that application ... shall be enforceable only for and during such period that said patent is commonly owned with the application or patent which formed the basis for the judicially created double patenting." 37 C.F.R § 1.32 l(c )(3) ( emphasis added). By tying enforceability to continued common ownership, the regulation mitigates against the risk of multiple, essentially redundant, lawsuits thereby supporting this rationale for ODP doctrine.
