We are guided by the principle that the claimed subject matter must be disclosed in the reference with sufficient specificity in order to constitute an anticipation. Atofina v. Great Lakes Chem. Corp, 441 F.3d 991, 999 (Fed. Cir. 2006) ("Atofina"). In the Atofina case, neither a disclosure of a broad range of 100-500° C., nor a disclosure of a narrower preferred range of 150-350° C., was found to anticipate a claimed range of 330-450° C., despite the former range fully encompassing the claimed range and the latter range having a degree of overlap with the claimed range. Moreover, although we appreciate the Examiner’s position that Nam’s CMOS structure is a field-effect transistor (see Ans. 3), we note that disclosure of a genus in the prior art, i.e., field-effect transistor, is not a disclosure of every species that is a member of that genus, i.e., thin film transistor. We assume the Examiner did not reject based on anticipation because (1) no embodiment (i.e., example) described by Sacchetti falls within the scope of claim 14 and (2) ranges described by Sacchetti do not fall within the scope of claim 14, albeit the Sacchetti ranges overlap those of claim 14.

Cir. 2006) (prior art temperature range of 100 to 500 ºC does not anticipate claimed range of 330 to 450 ºC.; prior art range of 0.001 to 1% oxygen to methylene chloride molar ratio does not anticipate range of 0.1 to 5.0%.; description of a genus in the prior art is not necessarily a disclosure of every species that is a member of that genus).

However, as is apparent from the claim chart, all the elements required by claim 14 are described by Sacchetti and the ranges of amounts of elements and property values described by Sacchetti overlap those of claim 14. Overlapping ranges establish the necessary prima facie case in the application on appeal. See In re Harris, 409 F.3d 1339, 1341 (Fed. Cir. 2005) (a prima facie case of obviousness arises when the ranges of a claimed composition overlap the ranges disclosed in the prior art); In re Boesch, 617 F.2d 272, 275 (CCPA 1980) (overlapping ranges establish a prima facie case of obviousness); In re Peterson, 315 F.3d 1325, 1329 (Fed. Cir. 2003) (a prima facie case of obviousness typically exists when the ranges of a claimed composition overlap the ranges disclosed in the prior art).

The Requester cites to a footnote in Intellectual Pro. Dev., Inc. v. UA-Columbia Cablevision of Westchester, Inc. in support of its assertions, but the footnote merely states that the court "see[s] no reason why, as a matter of law, one claim limitation may not be responsive to another merely because they are located in the same physical structure" in reversing a district courts granting of summary judgment of invalidity. Intellectual Pro. Dev., 336 F.3d 1308, 1320, fn. 9 (Fed. Cir. 2003). The footnote in Intellectual Pro. Dev. does not stand for the proposition that a single structure can be read upon multiple claim limitations would be reasonable and correct irrespective of the facts of the case. In fact, In re Kelly, also relied upon by the Requester and cited as precedent in the above noted footnote of Intellectual Pro. Dev., makes clear that claim interpretation must be reasonable.
