Appellants thus provide evidence of the criticality and results of the claimed coating thickness range compared to the prior art range of 8 mm to 10 mm. This evidence precludes the Examiner's finding that the claimed coating thickness is an obvious matter of design choice. See In re Chu, 66 F.3d 292, 299 (Fed. Our reviewing court has held that the patentability of an apparatus claim "depends on the claimed structure, not on the use or purpose of that structure." Catalina Marketing Int'l, Inc. v. In the context of a rejection based on design choice, the relevant issue is not necessarily whether the invention solves a stated problem or problems (nor whether the problems are known or unknown), but rather whether the alleged differences between the invention and the prior art "result in a difference in function or give unexpected results" or whether they are "no more than obvious variations consistent with the principles known in the art." See In re Rice, 341 F.2d 309, 314 (CCPA 1965). ...

Further, Appellants have not set forth any evidence showing unexpected results as compared to the prior art regarding, for example, reduced weight or avoiding discontinuities. Cf. In re Chu, 66 F.3d 292, 298-99 (Fed. Cir. 1995) (reversing an obviousness rejection based on evidence of unexpected results and distinguishing cases affirming rejections in which the parties failed to provide any evidence).

We are not persuaded by the Examiner's assertion of "design choice" because Appellant has disclosed that the claimed design acheived desired different functions different from the prior art.  See In re Gal, 980 F.2d 717, 719 (Fed. Cir. 1992); see also In re Chu, 66 F.3d 292, 299 (Fed. Cir. 1995) (holding that a claimed feature was not a matter of design choice where there was no suggestion or teaching to modify the prior art in this manner and applicant introduced evidence showing the benefits of the claimed feature).

We are also not persuaded by the Examiner's design choice argument relying on In re Rose.  In Rose, the invention was drawn to lumber packages formed into bundles with encircling bands, which could be lifted by hand in the prior art, but where the claimed packages required a lift truck.  In re Rose, 220 F.2d 459, 463 (CCPA 1955) ("the size of the article under consideration ... is not ordinarily a matter of invention.")...

We therefore agree with the Appellants that because "replacing the bendable tube of Nunley with the ball of the present invention changes how Nunley operates, the modification proposed by the Examiner cannot render claim 1 obvious" (App. Br. 6). See In re Chu, 66 F.3d 292, 299 (Fed. Cir. 1995) (finding of "obvious design choice" precluded where the claimed structure and the function it performs are different from the prior art).

In support of their contention that the additional limitations of claims 4-6 and 9 are not merely matters of design choice, Appellants cite In re Chu, 66 F.3d 292 (Fed. Cir. 1995). App. Br. 9-17; Reply Br. 8-17. To the contrary, Chu supports the Examiner‟s conclusion that such modifications were a matter of obvious design choice where, as here, Appellants fail to describe any difference in function between the prior art and the claims, or to identify any unexpected results attributable to the limitations of those claims. In re Chu, at 298-99 (a finding of “design choice” is appropriate where the applicant fails to set forth any reasons why the differences between the claimed invention and the prior art would result in a different function or give unexpected results (citing In re Rice, 341 F.2d 309, 314 (CCPA 1965)). Further, Appellants‟ contention that the proposed modification is not merely a matter of design choice, “since there is no teaching or suggestion in the art” (App. Br. 10) is unpersuasive because the Supreme Court has rejected the rigid requirement for a teaching, suggestion or motivation to be in the prior art.
