“[A]n inventive concept can be found in the non-conventional and non generic arrangement of known, conventional pieces,” even if these pieces constitute generic computer-related components. Bascom Global Internet v. AT&T Mobility LLC , 827 F.3d 1341, 1350 (Fed. Cir. 2016). The instant claims are similar to those in Bascom in that as in Bascom, an intermediary is inserted between two otherwise conventional computer nodes to move the location where a process is otherwise ordinarily executed. In Bascom it was filtering and in the instant claims it is checking on credit use limitations. The reasons for moving are similar in both cases and are rooted in the ways of internet technology.

Moreover, Appellant has not demonstrated the Examiner’s proffered combination of references would have been “uniquely challenging or difficult for one of ordinary skill in the art.” See Leapfrog Enters., Inc. v.
Fisher-Price, Inc., 485 F.3d 1157, 1162 (Fed. Cir. 2007) (citing KSR, 550 U.S. at 418). Nor has Appellant provided objective evidence of secondary considerations which our reviewing court guides “operates as a beneficial check on hindsight.” Cheese Systems, Inc. v. Tetra Pak Cheese and Powder
Systems, 725 F.3d 1341, 1352 (Fed. Cir. 2013). (See also App. Br. 26, “Evidence Appendix None.”)

To the extent that Appellant advances a “teaching away” argument (“Gomes points away from the invention of locating IP information for the user. Gomes would have eliminated documents to speed up search, which is not the objective of the present invention.” (App. Br. 8)), “[a] finding that two inventions were designed to resolve different problems . . . is insufficient to demonstrate that one invention teaches away from another.” Nat'l Steel Car, Ltd. v. Canadian Pac. Ry., Ltd., 357 F.3d 1319, 1339 (Fed. Cir. 2004). A reference does not teach away if it merely expresses a general preference for an alternative invention from amongst options available to the ordinarily skilled artisan, and the reference does not discredit or discourage investigation into the invention claimed. In re Fulton, 391 F.3d 1195, 1201 (Fed. Cir. 2004).

The Federal Circuit concluded that it would have been obvious to combine (1) a mechanical device for actuating a phonograph to play back sounds associated with a letter in a word on a puzzle piece with (2) an electronic, processor-driven device capable of playing the sound associated with a first letter of a word in a book. Leapfrog Ent., Inc. v. Fisher-Price, Inc., 485 F.3d 1157, 1161 (Fed. Cir. 2007) (“[a]ccommodating a prior art mechanical device that accomplishes [a desired] goal to modern electronics would have been reasonably obvious to one of ordinary skill in designing children’s learning devices”). In reaching that conclusion, the Federal Circuit recognized that “[a]n obviousness determination is not the result of a rigid formula disassociated from the consideration of the facts of a case. Indeed, the common sense of those skilled in the art demonstrates why some combinations would have been obvious where others would not.” Id. at 1161 (citing KSR, 127 S.Ct. 1727, 1739 (2007) (“The combination of familiar elements according to known methods is likely to be obvious when it does no more than yield predictable results.”). The Federal Circuit relied in part on the fact that Leapfrog had presented no evidence that the inclusion of a reader in the combined device was “uniquely challenging or difficult for one of ordinary skill in the art” or “represented an unobvious step over the prior art.” Id. (citing KSR, 127 S.Ct. at 1740-41).

And even if we were to assume that claim 1’s automatic functionality somehow precludes any manual activity whatsoever (which it does not for the reasons noted above), it is well settled that where, as here, merely providing an automatic means to replace manual activity to accomplish the same result (i.e., executing an application and completing a set of test features) is an obvious improvement. See In re Venner, 262 F.2d 91, 95 (CCPA 1958). Nor have Appellants shown that automatically performing these functions in lieu of at least some manual interaction would have been uniquely challenging or otherwise beyond the level of ordinarily skilled artisans. See Leapfrog Enters., Inc. v. Fisher-Price, Inc., 485 F.3d 1157, 1162 (Fed. Cir. 2007).
