The rejection relies upon a construction of the expression “supported for rotation” that would render superfluous the words “for rotation.” “A claim construction that gives meaning to all the terms of the claim is preferred over one that does not do so.” Merck & Co. v. Teva Pharms. USA, Inc., 395 F.3d 1364, 1372 (Fed. Cir. 2005). Ascribing meaning to the phrase “for rotation” here requires that the identified element be capable of rotation. An element that is fixed to another structure, such that it cannot rotate, is not “supported for rotation,” per claim 17.

We agree with Appellant. The broadest reasonable interpretation does not mean the broadest possible interpretation. See Microsoft Corp. v. Proxyconn, Inc., 789 F.3d 1292, 1298 (Fed. Cir. 2015) (stating that although claim terms must be given their broadest reasonable interpretation, the interpretation must still be reasonable). The claims do not recite “maintaining” a given throwback distance; rather the claim recites “adjustably maintaining” the throwback distance. The Examiner’s construction of “adjustably maintaining the throwback distance substantially constant” that covers a method where the throwback distance cannot be adjusted during printing would render the term “adjustably” superfluous and is unreasonable. See Merck & Co. v. Teva Pharms. USA, Inc., 395 F.3d 1364, 1372 (Fed. Cir. 2005) (rejecting a proposed claim construction that would render claim terms superfluous).

The Examiner contends that, according to In re Dulberg, 289 F.2d 522 (CCPA 1961), “constructing a formerly integral structure [into] various elements involves only routine skill in the art.” (Final Act. 6–7.)

We are persuaded by the Appellants’ argument that the Examiner does not establish why one of ordinary skill in the art would have an apparent reason to cut Lu’s rubber pad into separate parts. (See Appeal Br. 18–25.) In the Dulberg case cited by the Examiner, the claimed lipstick holder had a removable cap. (Dulberg, 289 F.2d at 523.) The court held that “[i]f it were considered desirable for any reason” to allow access to the capped area of the prior art lipstick holder, “it would be obvious to make the cap removable for that purpose.” ( Id. at 523 (emphases added).) Here, the Examiner does not explain, sufficiently, why it would be “considered desirable for any reason” to cut Lu’s rubber pad into separate pieces.

The Examiner's interpretation would likewise render the expressly recited claim term "probabilistic" superfluous.  Such an interpretation would be contrary to the canons of claim construction.  "A claim construction that gives meaning to all the terms of the claim is preferred over one that does not do so." Merck & Co. v. Teva Phams. USA, Inc., 395 F.3d 1364, 1372 (Fed. Circ. 2005). We therefore find the Examiner's claim construction of  "a probabilistic model" unreasonable broad.
