Furthermore, "apparatus claims may appropriately use functional language" and such claims require "that the apparatus as provided must be 'capable' of performing the recited function, not that it might later be modified to perform that function." Typhoon Touch Technologies, Inc. v. Dell, Inc., 659 F.3d 1376, 1380 (Fed. Cir. 2011) (citing Microprocessor Enhancement Corp. v. Texas Instruments, Inc., 520 F.3d 1367 (Fed.Cir.2008)); see also Ex parte Tsutsumi, No. 2010-005520, 2012 WL 6107993, *2 (PTAB Nov. 6, 2012).

Typhoon Touch Inc. v. Dell Inc., 659 F.3d 1376, 100 USPQ2d 1690 (Fed. Cir. 2011) 2181

We agree with Appellants that the disputed limitation is not directed to an intended use but to reciting functional capabilities of structure. Furthermore, language describing what the "processor is for," when read in context, is not merely a desired result as in a process claim but, instead, defines required structure for performing the recited functions of "controlling the motor drives using images captured by the calibration camera such that the motion of the camera pods is synchronous with each other."

As an initial matter, we reject the Examiner's position that the limitations of claims 1, 9, and 18 reciting structure "configured to" send data and, in claims 1 and 18, to also send a "request for standardization," are not "limitation[ s] of the claimed processor but rather [are statements of] intended use and as such does not further limit the claim." Final Act. 2. When claimed functional language is associated with programming or some other structure required to perform the function, that programming or structure cannot be ignored by the Examiner when applying the prior art. See, e.g., Typhoon Touch Techs., Inc. v. Dell, Inc., 659 F.3d 1376, 1380 (Fed. Cir. 2011) (discussing Microprocessor Enhancement Corp. v. Tex. Instruments, Inc., 520 F.3d 1367 (Fed. Cir. 2008)).

Thus, although Evers' controller may capable of being modified to perform the functions of the "controller," as required in independent claims l, 12, 17, and 18, such a disclosure fails to satisfy the "capable of" test which requires that the prior art structure be capable of performing the function without further programming. Typhoon Touch Techs., Inc. v. Dell, Inc., 659 F.3d 1376, 1380 (Fed. Cir. 2011) (discussing Microprocessor Enhancement Corp. v. Texas Instruments, Inc., 520 F.3d 1367 (Fed. Cir. 2008)). When the functional language is associated with programming or some other structure required to perform the function, that programming or structure must be present in order to meet the claim limitation. While it might be possible to install software and/or hardware that would allow Hanawa’s controller to perform the functions of controlling movement, tracking location and determining the path for each of a plurality of test vessels as required in claim 1 and 13, the “capable of” test requires that the prior art structure be capable of performing the function without further programming. Id. While in some circumstances generic structural disclosures may be sufficient to meet the requirements of a “controller,” see Ergo Licensing, LLC v. CareFusion 303, Inc., 673 F.3d 1361, 1364 (Fed. Cir. 2012) (citing Telcordia Techs., Inc. v. Cisco Sys., Inc., 612 F.3d 1365, 1376–77 (Fed. Cir. 2010)), that is not the case here.

The collection of a blood sample from a patient is a “well-understood, routine, conventional activity previously engaged in by researcher in the field” that is insufficient to transform an abstract idea into an eligible concept. See Mayo Collaborative Servs. v. Prometheus Labs, Inc., 132 S.Ct. at 1294-1298 (“Purely conventional or obvious‟ '[pre]-solution activity' is normally not sufficient to transform an unpatentable law of nature into a patent-eligible application of such a law.”); accord Perkinelmer, Inc. v. Intema Ltd., 2012 WL 5861658, *5 (Fed. Cir. 2012) (purely conventional “measuring” steps insufficient to make the claims reciting mental processes and natural laws patent-eligible).
