We agree with Appellant that these results represent an unexpected and substantial improvement over the prior art.  See In re Soni, 54 F.3d 746, 751 (Fed. Cir. 1995) (“[W]hen an applicant demonstrates substantially improved results, as Soni did here, and states that the results are unexpected, this should suffice to establish unexpected results in the absence of evidence to the contrary.”)

To the extent that the statement in paragraph 9 of the Schmitz Declaration that thinly metallized film made with PLA film "is gaining unexpectedly - excellent barrier properties" as compared to conventional laminate paper is evidence of improved results, it is weak evidence, as no data was supplied in the Declaration in support of this statement, and thus, no quantification of the extent of the improvement can be discerned. See Bristol-Myers Squibb Co. v. Teva Pharmaceuticals USA, Inc., 769 F.3d 1339 (per curiam) (Fed. Cir. 2014) ("[O]ne should consider the substantiality of the differences between the properties of the prior art and those of the invention to determine the significance of those differences."); In re Soni, 54 F.3d 746, 751 (Fed. Cir. 1995) ("Mere improvement in properties does not always suffice to show unexpected results.").

We next turn to Appellants’ attempt to rebut the prima facie case of obviousness by evidence “of ‘unexpected results,’ i.e., to show that the claimed invention exhibits some superior property or advantage that person of ordinary skill in the relevant art would have found surprising or unexpected.” In re Soni, 54 F.3d 746, 750 (Fed. Cir. 1995). “[W]hen unexpected results are used as evidence of nonobviousness, the results must be shown to be unexpected compared with the closest prior art.” In re Baxter Travenol Labs., 952 F.2d 388, 392 (Fed. Cir. 1991). The unexpected results must be “different in kind and not merely in degree from the results of the prior art.” In re Applied Materials, Inc., 692 F.3d 1289, 1297 (Fed. Cir. 2012).

The Examiner further finds Amine Declarant's statement that the synergy between the anion receptor and the electrode stabilizer as evidenced by Figures 6 and 7 was suprising and unexpected "is not evidence of unexpected results."  Ans. 10.  However, while we agree that the statement alone is not evidence of unexpected results, it is an essential component of Appellants' evidentiary showing.  In re Soni, 54 F.3d 745, 751 (Fed. Cir. 1995) ("Mere improvement in properties does not always suffice to show unexpected results.  In our view, however, when an applicant demonstrates substantially improved results ... and states that the results were unexpected, this should suffice to establish unexpected results in the absense of evidence to the contrary.")
