We find the Examiner’s reasoning to be sufficient to support the finding that Moody I inherently teaches “determining a number” of email messages, as claimed. Although a finding of inherency in the context of obviousness must meet a “high standard,” PAR Pharmaceutical, Inc. v. TWI Pharmaceuticals, Inc., 773 F.3d 1186, 1195 (Fed. Cir. 2014), the Examiner has satisfied it here, as “the limitation at issue necessarily must be present,” id. at 1196.

As our reviewing court has explained, “the use of inherency, a doctrine originally rooted in anticipation, must be carefully circumscribed in the context of obviousness.” PAR Pharmaceutical, Inc. v. TWI Pharmaceuticals, Inc., 2014 WL 6782649, 6 (Fed. Cir. 2014). In particular:

Inherency . . . may not be established by probabilities or possibilities. The mere fact that a certain thing may result from a given set of circumstances is not sufficient. If, however, the disclosure is sufficient to show that the natural result flowing from the operation as taught would result in the performance of the questioned function, it seems to be well settled that the disclosure should be regarded as sufficient. 


Id. at 7 (citing In re Oelrich, 666 F.2d 578, 581 (Fed. Cir. 1981). Hence, “the concept of inherency must be limited when applied to obviousness, and is present only when the limitation at issue is the ‘natural result’ of the combination of prior art elements.” Id. (emphasis added).
