A determination of indefiniteness “requires a construction of the claims according to the familiar canons of claim construction. Only after a thorough attempt to understand the meaning of a claim has failed to resolve material ambiguities can one conclude that the claim is invalid for indefiniteness.” All Dental Prodx, LLC v. Appellants argue claims 4, 10, and 14 in the conclusion of the Appeal Brief (Br. 14); and Appellants have not clearly stated in the Appeal Brief that some of the finally rejected claims (e.g., claims 4, 10, and 14) are not being pursued in the appeal. See Ex parte Ghuman, 88 USPQ2d 1478 (BPAI 2008) (precedential) (holding that when appellants are silent in the notice of appeal as to the specific claims being appealed, and then clearly state in the appeal brief that some of the finally rejected claims are not being pursued in the appeal, appellants should cancel those claims not pursued). As such, the facts of the instant case are not congruent with the facts of Ex parte Ghuman, and we consider Appellants to appeal under 35 U.S.C. § 134(a) from the Examiner’s rejection of claims 1, 2, 4, 7-12, 14, and 20-32. We have jurisdiction under 35 U.S.C. § 6(b). An oral hearing was conducted on October 22, 2013.

The Examiner has properly concluded that Appellant errs in arguing that an applicant's own patented work is only a statutory bar if a rejection is based on 35 U.S.C. §102(b) and not on 35 U.S.C. § 103. It is well settled that prior art available under 35 U.S.C. § 102 is also available as prior art under 35 U.S.C. § 103 (see MPEP 2141.01, and Ex parte Andresen, 212 USPQ 100, 102 (BPAI 1981). We do not agree with the Examiner’s reasoning. First, although a reference can anticipate without a specific example directed to the claimed invention, that exception to the general rule of anticipation is a limited one. See In re Petering, 301 F.2d 676, 681-82 (CCPA 1962) (A disclosure that allows one skilled in the art to “at once envisage each member of [a] limited class” describes each member of the class “as if [the reference] had drawn each structural formula or had written each name.”). It does not apply to a situation where, as here, limitations must be selected from different parts of a reference that are not clearly associated with each other, and where a further choice must be made from among a list of numerous possible components.
Petering, In re, 301 F.2d 676, 133 USPQ 275 (CCPA 1962) 2131.02, 2131.03, 2144.08

The “principle of operation” referred to by Appellants relates to the “basic principles” under which the prior art device was designed to operate. In re Ratti, 270 F.2d 810, 813 (CCPA 1959). Under In re Ratti, “a change in the basic principles” refers to change that is fundamental in scope so as to relate to scientific or technical principles under which the invention is designed to operate. We are not persuaded that a “change in the basic principles” occurs by making Liang ’955’s exhaust orifices 48 smaller when Liang ’955’s device, even as modified by Parker, continues to exhaust cooling fluids.
