Thus claims 1 and 9 do not apprise a person of ordinary skill in the art of their scope, and thus, fail to comply with 35 U.S.C. § 112, second paragraph. See IPXL Holdings, L.L.C. v. Amazon.com, Inc., 430 F.3d 1377, 1384 (Fed. Cir. 2005) (noting that when a claim recites both a system and a method for using that system, it is unclear whether infringement occurs when (1) one creates a system that allows a user to perform the recited method, or (2) the recited method actually occurs).

The Examiner’s rejection of claims 3 and 16 constitutes an implied rejection of the broader claims 1, 2, 13, and 15.Ex parte Janakiraman, 2009 WL 1270322 (BPAI 2009) (Informative); see alsoOrmco Corp. v. Align Tech., Inc., 498 F.3d 1307, 1319 (Fed. Cir. 2007) (When the subject matter of dependent claims is determined to have been obvious, the broader subject matter of the claims from which they depend must also be determined to have been obvious.);In re Muchmore, 433 F.2d 824, 824–25 (CCPA 1970) (“Since we agree with the board's conclusion of obviousness as to these narrow claims, the broader claims must likewise be obvious.”). Therefore, we sustain the rejection of claims 3, 5, 16, and 17

While de Mint is silent as to from where these instructions are executed (server side or user computer side), we find that the mere existence of differences between the prior art and the claim does not establish nonobviousness. Dann v. Johnston, 425 U.S. 219, 230 (1976). The issue is “whether the difference between the prior art and the subject matter in question ‘is a differen[ce] sufficient to render the claimed subject matter unobvious to one skilled in the applicable art.’” Dann, 425 U.S. at 228 (citation omitted) (finding system for automatic record keeping of bank checks and deposits obvious in view of nature of extensive use of data processing systems in banking industry and “closely analogous” patent for an automatic data processing system used in a large business organization for keeping and updating system transaction files for each department of the organization).

3754 Ex Parte Boyd et al 11512653 - (D) MAYBERRY 112(2)/103 ALCON RESEARCH LTD. NICHOLS II, ROBERT K

The Examiner concludes that “[a] change in form or shape is generally recognized as being within the level of ordinary skill in the art, absent any showing of unexpected results.” Id. (citing In re Dailey, 357 F.2d 669 (C.C.P.A. 1966)).

See In re Dailey, 357 F.2d at 672–73.Cf. In re Gal, 980 F.2d 717, 719  (Fed. Cir. 1992) (finding that the claimed structure and prior art structure “achieve different purposes” and, as a result, the claimed structure was not a matter of design choice).

In short, Appellants’ Specification assigns or suggests to a person of ordinary skill in the art a particular scope or definition of these terms such that, in order to resolve the matter at hand, resort to a broader or a general dictionary definition of these terms for guidance is not justified. See Comaper Corp. v. Antec, Inc., 596 F.3d 1343 (Fed. Cir. 2010).

In Comaper, “[t]he patent specification [did] not assign or suggest a particular definition to the term ‘case’. Therefore, in determining the meaning of the claim term as viewed by a person of ordinary skill in the art, it is appropriate to consult a general dictionary definition of the word for guidance.” Comaper, 596 F.3d at 1348.

“The evidence presented to rebut a prima facie case of obviousness must be commensurate in scope with the claims to which it pertains.” In re Dill, 604 F.2d 1356, 1361, 202 USPQ 805, 808 (CCPA 1979). “It is well established that the objective evidence of nonobviousness must be commensurate in scope with the claims.” In re Lindner, 457 F.2d 506, 508 (CCPA 1972).

“Commensurate in scope” means that the evidence provides a reasonable basis for concluding that the untested embodiments encompassed by the claims would behave in the same manner as the tested embodiment(s). See Lindner, 457 F.2d at 508 (“Here, only one mixture of ingredients was tested . . . . The claims, however, are much broader in scope, . . . and we have to agree with the Patent Office that there is no ‘adequate basis for reasonably concluding that the great number and variety of compositions included by the claims would behave in the same manner as the [single] tested composition.’” (bracketed material in original)).

Generally, for a combination to be obvious to one skilled in the art there must be at least a reasonable expectation that the combination would successfully yield a functioning device. See In re O’Farrell, 853 F.2d 894, 903–04 (Fed. Cir. 1988). Whether there is a reasonable expectation of success is a question of fact. Medichem S.A. v. Rolabo S.L., 437 F.3d 1157, 1165–66 (Fed. Cir. 2006).
