We also disagree with the Examiner’s treatment of the claimed functional language for the analyzing unit as merely an intended use that “does not differentiate the claimed apparatus from a prior art apparatus satisfying the claimed structural limitations” (Ans. 6). We consider the claimed “analyzing unit” to be akin to a processor programmed to perform the particular function of determining the direction of the capsule. When the functional language of a claim is associated with programming or some other structure required to perform the function, that programming or structure must be present in order to meet the claim limitation. See Typhoon Touch Techs., Inc. v. Dell, Inc., 659 F.3d 1376, 1380 (Fed. Cir. 2011); see also Vizio, Inc. v. Int'l Trade Comm’n, 605 F.3d 1330, 1341 (Fed. Cir. 2010) (“[T]he ‘for decoding’ language . . . is properly construed as a limitation, and not merely a statement of purpose or intended use for the invention, because ‘decoding’ is the essence or a fundamental characteristic of the claimed invention.”).

The Federal Circuit has explained that “[t]he analogous art inquiry is a factual one, requiring inquiry into the similarities of the problems and the closeness of the subject matter as viewed by a person of ordinary skill in the art.” Scientific Plastic Prods., Inc. v. Criteria for determining whether prior art is analogous may be summarized as “(1) whether the art is form the same field of endeavor, regardless of the problem addressed, and (2) if the reference is not within the field of the inventor’s endeavor, whether the reference still is reasonably pertinent to the particular problem with which the inventor is involved.” Id. at 1359 (quoting In re Clay, 966 F.2d 656, 658–59 (Fed. Cir. 1992)). A reference is reasonably pertinent if . . . it is one which, because of the matter with which it deals, logically would have commended itself to an inventor’s attention in considering his problem. If a reference disclosure has the same purpose as the claimed invention, the reference relates to the same problem, and that fact supports use of that reference in an obviousness
