We agree with Appellant. As the Examiner found, Fine describes at least two genera of binding units that comprise both positively and negatively charged species. See Final Act. 6 (citing Fine ¶ 14). Thus, claim 1 is directed to subgenera while Fine contains a generic disclosure. In general, disclosure of a genus is not sufficient to anticipate a claim to a member or members of the genus. See, e.g., In re Schaumann, 572 F.2d 312, 316 (CCPA 1978); In re Petering, 301 F.2d 676, 681 (CCPA 1962). Although there are exceptions to this general rule, application of these exceptions requires factual determinations that are not in the record before us.

The Examiner, therefore, erred by finding that Fine’s description of binding units comprising either fluorescent dyes or toxins anticipates claims directed to the sub-genera of positively-charged fluorescent dyes or positively-charged toxins.
