Although “[a] person of ordinary skill in the art is also a person of ordinary creativity, not an automaton,” KSR 550 at 421, there may be limits in a particular case as to how much gap-filling may be based on such creativity. See Arendi S.A.R.L. v. Apple Inc., 832 F.3d 1355, 1361–63 (Fed. Cir. 2016). As stated in Arendi:

Though less common, in appropriate circumstances, a patent can be obvious in light of a single prior art reference if it would have been obvious to modify that reference to arrive at the patented invention. See, e.g., Takeda Chem. Indus., Ltd. v. Alphapharm Pty, Ltd., 492 F.3d 1350, 1357 (Fed. Cir. 2007); SIBIA Neurosciences, Inc. v. Cadus Pharm. Corp., 225 F.3d 1349, 1356 (Fed. Cir. 2000).

Here, the Examiner has not sufficiently identified supporting evidence why one of ordinary skill in the art would, based on the teaching or suggestion of Cerrelli, add a physical connection via a USB cable while still utilizing the wireless connection to transfer data between the host device and the SSD device.

The Federal Circuit provides a two-prong analysis to determine whether a new chemical compound is prima facie obvious over particular prior art.  The fact finder first determines whether a chemist of ordinary skill would have selected the asserted prior art compounds as lead compounds, or starting points, for further development efforts.  Otsuka Pharm. Co. Ltd. v. Sandoz Inc., 678 F.3d 1280, 1291 (Fed. Cir. 2012). The Court defines a lead compound as "a compound in the prior art that would be most promising to modify in order to improve upon its ... activity and obtain a compound with better activity," Takeda Chem. Indus., Ltd. v. Alphapharm Pty. Ltd., 492 F.3d 1350, 1357 (Fed. Cir 2007), or "a natural choice for further development efforts." Altana Pharma AG v. Teva Pharm. USA, Inc., 566 F.3d 999, 1008 (Fed. Cir 2009).  The second step involves determining "whether the prior art would have supplied one of ordinary skill in the art with a reason or motivation to modify a lead compound to make the claimed compound with a  reasonable expectation of success." Otsuka, 678 F.3d at 1292 (citing Takeda, 492 F.3d at 1357)

We thus find that the Examiner's conclusion of obviousness is not supported by facts, and thus, cannot stand. See In re Warner, 379 F.2d 1011, 1017 (CCPA 1967). Moreover, the Examiner has not provided evidence or reasoning that one of ordinary skill had “good reason to pursue the known options within his or her technical grasp.” See Takeda Chem. Indus., Ltd. v. Alphapharm Pty., Ltd., 492 F.3d 1350, 1359 (Fed. Cir. 2007) (discussing the requirements of an “obvious to try”-type obviousness rejection) (internal quotations and citation omitted).

(Otsuka Pharm. Co. v. Sandoz Inc., 678 F.3d 1280, 1291 (Fed. Cir. 2012). The Court defines a lead compound as “a compound in the prior art that would be most promising to modify in order to improve upon its ... activity and obtain a compound with better activity,” (Takeda Chem. Indus., Ltd. v. Alphapharm Pty., Ltd., 492 F.3d 1350, 1357 (Fed. Cir. 2007), or “a natural choice for further development efforts.” Altana Pharma AG v. Teva Pharm. USA, Inc., 566 F.3d 999, 1008 (Fed. Cir. 2009). The second step involves determining “whether the prior art would have supplied one of ordinary skill in the art with a reason or motivation to modify a lead compound to make the claimed compound with a reasonable expectation of success.” Otsuka, 678 F.3d at 1292 (citing Takeda, 492 F.3d at 1357).

What is missing from the rejection is some reason that would have led the person of ordinary skill in the art to select Stelmach’s compounds exemplified in Examples 8, 24A, and 24B as lead compounds and further to modify those compounds with the structural changes required to arrive at the elected species.  See Takeda Chemical Industries Ltd. v. Alphapharm Pty., Ltd., 492 F.3d 1350, 1357 (Fed. Cir. 2007).
