Interpreting the claim term “removably” to mean merely being capable of being removed so as to encompass dissolution of the adhesive or disruption of other conventional and generally permanent attachment methods identified in Lee does not give appropriate weight to the meaning of that term and is not consistent with the nature of the attachment method disclosed by Appellants. See Bicon, Inc. v. Straumann Co., 441 F.3d 945, 950 (Fed. Cir. 2006) and In re Danly, 263 F.2d 844, 847 (CCPA 1959) (appellant has used such phrases as “for holding” and “for insulating” throughout the appealed claims with the obvious intention of limiting them to actual performance of the stated functions, as distinguished from mere possibility of such performance). The Examiner’s interpretation essentially renders the terms in the claims superfluous as most attachment methods are capable of being removed if exposed to some outside destructive force. Thus, the Examiner’s interpretation is unreasonably broad as it effectively would expunge the term “removably” from the claim language. See Stumbo v. Eastman Outdoors, Inc., 508 F.3d 1358, 1362 (Fed. Cir. 2007) (denouncing claim constructions that render phrases in claims superfluous).

We note that the Manual of Patent Examining Procedure (MPEP) § 2111.04, entitled “‘Adapted to,’ ‘Adapted For,’ “Wherein,’ and “Whereby’ Clauses,” indicates that “[c]laim scope is not limited by claim language that suggests or makes optional but does not require steps to be performed, or by claim language that does not limit a claim to a particular structure.” This section of the MPEP sets forth a non exhaustive list of claim language “that may raise a question as to the limiting effect of the language in a claim,” and the list includes “‘wherein’ clauses.” This section of the MPEP also indicates that “[t]he determination of whether each of these clauses is a limitation in a claim depends on the specific facts of the case,” and discusses that “[i]n Hoffer v. Microsoft Corp., 405 F.3d 1326, 1329 . . . (Fed. Cir. 2005), the court held that when a ‘whereby’ clause states a condition that is material to patentability, it cannot be ignored in order to change the substance of the invention.”

The Examiner concluded that it would have been obvious to modify Kitaori so that the plurality of segment pieces are setback as called for in claim 1,
since it has been held that where the general conditions of a claim (which are segment pieces being setback from the outer peripheral edges of the core plate) are disclosed in the prior art, discovering the optimum or workable ranges involves only routine skill in the art.

The Examiner misapplies the principle set forth in Aller. There, the Court counseled that if one skilled in the art can discover the optimum or workable ranges by routine experimentation, where the general conditions of a claim are disclosed in the prior art, the differences between the claimed invention and the prior art may not be patentable differences. Aller, 220 F.2d at 827. Rather than showing that only routine experimentation would be involved in an optimization exercise directed to the setback of the plurality of segment pieces, the Examiner presumed that because the general conditions of the claim were met, discovery would have involved only routine skill.
