Merely establishing that there are differences between the two references is not sufficient to establish that one or both of the references “teaches away” from their combination. See In re Beattie, 974 F.2d 1309, 1312-13 (Fed. Cir. 1992) (determining that two prior art references having different theories of musical notation systems does not make a sound prima facie case of obviousness impossible).
