“A patent applicant is free to recite features of an apparatus either structurally or functionally . . . Yet, choosing to define an element functionally, i.e., by what it does, carries with it a risk.” In re Schreiber, 128 F.3d 1473, 1478 (Fed. Cir. 1997) (internal citation omitted). ...

See Schreiber at 1477-78 (once the Examiner finds that the prior art structure would be capable of performing all of the functions claimed, the burden shifts to the applicant to show this this is not the case.).

Our reviewing court has stated the phrase "'[i]n response to' connotes that the second event occur in reaction to the first event." Am. Calcar, Inc. v. Am. Honda Motor Co., 651 F.3d 1318, 1340 (Fed, Cir. 2011).  Applying this logic to the instant case we find that when a menu item is activated in claim 1, the "displaying" recited in part [d] must happen "automatically as opposed to requiring further user interaction." The scope of the claims must not be broader than the scope of the enabling description in the specification. See Nat’l Recovery Tech., Inc. v. Magnetic Separation Systems, Inc., 166 F.3d 1190, 1196 (Fed. Cir. 1999). “The scope of enablement, in turn, is that which is disclosed in the specification plus the scope of what would be known to one of ordinary skill in the art without undue experimentation.” Id. (citation omitted). ...

Arts based on chemical reactions may be unpredictable. In re Fisher, 427 F.2d 833, 839 (C.C.P.A. 1970). “In cases involving unpredictable factors, such as most chemical reactions and physiological activity, the scope of enablement obviously varies inversely with the degree of unpredictability of the factors involved.” Id.

When the Specification specifies an object or goal of the invention, as here, we interpret the claims in the manner that would allow the claimed invention to meet such objective or goal, i.e., exposing a medical device to a highly pressurized CO2-based mixture in a pressure chamber for a prolonged period to achieve a safe endotoxin level on such medical device. In re Rambus, Inc., 694 F.3d 42, 50 (Fed. Cir. 2012) (stating that when the Specification specifies an object or goal of the invention, any claim construction or interpretation that would have rendered the claimed invention incapable of meeting that objective or goal is incorrect) (citing Lisle Corp. v. We are not persuaded the Examiner erred.  We begin our analysis by construing the steps reciting "responsive to" in claim 1.  Claim 1 recited two sets of steps each responsive to one of two mutually exclusive conditions. ... see also In re Johnston, 435 F..3d 1381, 1384 (Fed. Cir. 2006) ("optional elements do not narrow the claim because they can always be omitted.").  In particular, claim 1 recites steps to be performed "responsive to determining ... that the cursor is present in the input field" and steps responsive to determining the opposite condition (cursor not in the input field.)
...
I do not believe In re Johnston supports the Majority's position.

Distinguishable from the present application, In re Johnston analyzed the linguistic precision of optional elements, i.e., the claimed "said wall may be smooth, corrugated, or profiled ...." and affirmed the Board's ruling that such limitations "did not narrow the scope of the claim because these limitations are stated in the permissive form 'may'" (see In re Johnston at 1384)(emphasis added).  The majority has not identified any similar permissive language in the present application and in any case, fails to point out precisely what they consider to be "optional" language in claim 1.  I believe the facts of In re Johnston highlights the concept of being "optional" when the claim language indicated that a limitation may be chosen and the Majority has not explained why the presently claimed responsive to steps are similarly optional, i.e., how the claim language signifies choosing between the different responsive to steps.

"The law is replete with cases in which the difference between the claimed invention and the prior art is some range or other variable within the claims. ... In such a situation, the applicant must show that the particular range is critical, generally by showing that the claimed range achieves unexpected results relative to the prior art range."  In re Woodruff, 919 F.2d 1575, 1578 (Fed. Cir. 1990) (emphasis added). In the case, Applicants have not shown that the claimed angle ranges are critical.

Under 35 U.S.C. §112, first paragraph, negative claim limitations are “adequately supported when the specification describes a reason to exclude the relevant limitation.” Santarus, Inc. v. Par Pharm., Inc., 694 F.3d 1344, 1351 (Fed. Cir. 2012).

Appellant argues “[i]t is clear from page 4, lines 12 - 25 of the originally filed application that Appellant, at the time of filing the instant application, understood that the reactive layer composition does not need to contain yttria.” Reply Br. 3. The referenced portion of the Specification describes a single embodiment of the reactive layer composition. We do not find, and Appellant has not identified, any disclosure in the Specification indicating that the inventors intended to limit the reactive layer composition to this specific embodiment or to a composition that is free of components other than those explicitly listed. In other words, the disclosure of a particular composition which excludes a broad genus of components does not amount to a disclosure of a composition that excludes one particular compound. See In re Bimeda Research & Dev. Ltd., 724 F.3d 1320, 1323–24 (Fed. Cir. 2013) (finding substantial evidence supported the Board’s finding that “claim 32 failed the written description requirement because the disclosure did not describe[ ] a formulation excluding a specific species of the antiinfective genus, while permitting others to be present” (internal citations and quotations omitted)); cf. Howmedica Osteonics Corp. v. Wright Med. Tech., Inc., 540 F.3d 1337, 1345 (Fed. Cir. 2008) (“[T]he fact that the specification describes only a single embodiment, standing alone, is insufficient to limit otherwise broad claim language.”).
