1793 Ex Parte Lee et al 13391080 - (D) KENNEDY 102 Diederiks & Whitelaw, PLC TRAN, LIEN THUY

Although we agree with the Examiner that the disputed limitation is a functional limitation, to the extent that functional limitations imply structure, they cannot be ignored. See, e.g., Textron Innovations Inc. v. Am. Eurocopter Corp., 498 F. App’x 23, 28 (Fed. Cir. 2012) (“In certain circumstances functional language may be used to add limitations to an apparatus claim.”) (citing K-2 Corp. v. Salomon S.A., 191 F.3d 1356, 1363 (Fed. Cir. 1999) (“[T]he functional language tells us something about the structural requirements . . . .”)). By its plain language, claim 3 requires a rotating unit that is structurally capable of “rotating] a dumpling wrapper cut by the cutting unit relative to a dumpling die,” such as the rotating unit described by the Appellants’ Specification. See, e.g., Spec. 10:5-11; Fig. 7.

[T]he PTO applies to the verbiage of the proposed claims the broadest reasonable meaning of the words in their ordinary usage as they would be understood by one of ordinary skill in the art, taking into account whatever enlightenment by way of definitions or otherwise that may be afforded by the written description contained in the applicant’s specification.

In re Morris, 127 F.3d 1048, 1054 (Fed. Cir. 1997). In doing so, the Office may not read the claims in a way that would effectively expunge a term from the claim language. See K-2 Corp. v. Salomon S.A., 191 F.3d 1356, 1363 (Fed. Cir. 1999).

Although these limitations are set forth in terms of function or use in claim I (Ans. 5), they "tell[] us something about the structural requirements of the [device]." See K-2 Corp. v. Salomon S.A., 191 F.3d 1356, 1363 (Fed. Cir. 1999); accord Rowe v. Dror, 112 F. 3d 473, 479-80 (Fed. Cir. 1997). Clearly, the use of manipulative language does not similarly demonstrate breadth in method claims 17 and 22, as it is well-settled that the novelty of the device used is not dispositive as to the patentability of method claims. See, e.g., Catalina Marketing Int'l. v. Coolsavings.com, 289 F. 3d 801, 809-810 (Fed. Cir. 2002).

In order to satisfy the functional limitations in an apparatus claim, the prior art apparatus must be capable of performing the claimed function. See In re Schreiber, 128 F.3d 1473, 1478 (Fed. Cir. 1997). Thus, functional and intended use language must be evaluated to the extent it conveys structural requirements. See, e.g., K-2 Corp. v. Salomon S.A., 191 F.3d 1356, 1363 (Fed. Cir. 1999) (“The functional language is, of course, an additional limitation in the claim”).
