 “To qualify as prior art for an obviousness analysis, a reference must qualify as ‘analogous art,’ i.e., it must satisfy one of the following conditions: (1) the reference must be from the same field of endeavor; or (2) the reference must be reasonably pertinent to the particular problem with which the inventor is involved.”  K-TEC, Inc. v. Vita-Mix Corp., 696 F.3d 1364, 1375 (Fed. Cir. 2012)

We are further guided by In re Bigio, 381 F.3d 1320 (Fed. Cir. 2004) in which our reviewing court stated that the analogous art “test does not make the assessment of the field of endeavor a wholly subjective call for the examiner.”  Bigio, 381 F.3d at 1326

As an initial matter, although the Examiner did not proffer a claim construction, claim construction is an issue of law that is left for a court or a tribunal. "[W]hen the district court reviews only evidence intrinsic to the patent (the patent claims and specifications, along with the patent's prosecution history), the judge's determination will amount solely to a determination of law." Teva Pharms. USA, Inc. v. Sandoz, Inc., 135 S. Ct. 831, 841 (2015). "[T]he ultimate issue of the proper construction of a claim should be treated as a question of law." Id. at 838.

We construe claim terms according to their broadest reasonable construction in light of the specification of the patent or application in which they appear. In re Bigio, 381 F.3d 1320, 1324 (Fed. Cir. 2004).

At the outset, we note that: 

[ t ]wo separate tests define the scope of analogous prior art: (1) whether the art is from the same field of endeavor, regardless of the problem addressed and, (2) if the reference is not within the field of the inventor's endeavor, whether the reference still is reasonably pertinent to the particular problem with which the inventor is involved. 

In re Bigio, 381 F.3d 1320, 1325 (Fed. Cir. 2004) (citations omitted). As for the first test, "[ t ]h[ e field of endeavor] test for analogous art requires the PTO to determine the appropriate field of endeavor by reference to explanations of the invention's subject matter in the patent application,  including the embodiments, function, and structure of the claimed invention." Bigio at 1325-26 (emphasis added). As for the second test, "a reference is reasonably pertinent if, ... it is one which, because of the matter with which it deals, logically would have commended itself to an inventor's attention in considering his problem." In re Clay, 966 F.2d 656, 659 (Fed. Cir. 1992).

We agree with Appellants that Melican is not analogous art. The Examiner’s opposing view apparently is based on the proposition that the inventions of Melican and claim 1 are in the same field of endeavor because they are both directed to composites. However, such a proposition so broadly characterizes the field of Appellants’ endeavor as to render meaningless this aspect of the test for non-analogous art. Here, the Examiner has failed to “correctly set the field of the invention by consulting the structure and function of the claimed invention as perceived by one of ordinary skill in the art.” In re Bigio, 381 F.3d 1320, 1326 (Fed. Cir. 2004).

We note, "[d]uring prosecution . . . the PTO gives claims their 'broadest reasonable interpretation.'" In re Bigio, 381 F.3d 1320, 1324 (Fed. Cir. 2004) (quoting In re Hyatt, 211 F.3d 1367, 1372 (Fed. Cir. 2000)). We find the broadest reasonable interpretation of common claim element "hardware" does not exclude such hardware disclosed in Fig. 8 of the cited reference, nor does the broadest reasonable interpretation of "virtualization layer" preclude the inclusion of hardware device drivers in such a layer.

Appellant’s reliance on this purported prosecution disclaimer is unavailing. “[T]he PTO is under no obligation to accept a claim construction proffered as a prosecution history disclaimer, which generally only binds the patent owner.” Tempo Lighting, Inc. v. Tivoli, LLC, 742 F.3d 973, 978 (Fed. Cir. 2014). Rather, the PTO is obligated to give claims their broadest reasonable interpretation not inconsistent with the remainder of the specification. In re Zletz, 893 F.2d 319, 321 (Fed. Cir. 1989) (“[D]uring patent prosecution when claims can be amended, ambiguities should be recognized, scope and breadth of language explored, and clarification imposed.”) (citations omitted); see also In re Bigio, 381 F.3d 1320, 1325 (Fed. Cir. 2004) (counseling “the PTO to avoid the temptation to limit broad claim terms solely on the basis of specification passages”) (citation omitted). The PTO has been counseled that it “should only limit the claim based on . . . prosecution history [that] expressly disclaim[s] the broader definition.” Id. However, this is a caution against careless reliance on prosecution history by the PTO, not a mandate for the liberal reliance on prosecution disclaimer to allow broadly worded claims to be read narrowly without requiring clarifying amendments to the claims or to the Specification.
