In Japikse the court summarized the Patent Office position regarding shifting a switch having no effect on the operation of the claimed devices, and stated, without further discussion, "[w]e find no error in the holding." Although MPEP § 2144.04(IV)(C) cites Japikse as an example of using legal rationale as the basis for concluding that a rearrangement of parts was obvious, that same section of the MPEP also cautions (citing Ex parte Chicago Rawhide Mfg. Co., 223 USPQ 351, 353 (BPAI 1984)): 

[t]he mere fact that a worker in the art could rearrange the parts of the reference device to meet the terms of the claims on appeal is not by itself sufficient to support a finding of obviousness. The prior art must provide a motivation or reason for the worker in the art, without the benefit of appellant's specification, to make the necessary changes in the reference device.

"Pre-AIA section 102(g) allows a patent owner to antedate a reference by proving earlier conception and reasonable diligence in reducing to practice." Perfect Surgical Techniques, Inc. v. Olympus Am., Inc., 841 F.3d 1004, 1007 (Fed. Cir. 2016). "Reasonable diligence must be shown throughout the entire critical period, which begins just prior to the competing reference's effective date and ends on the date of the invention's reduction to practice." Id. 

"An attorney's work in preparing a patent application is evidence of an inventor's diligence." Perfect Surgical, 841 F.3d at 1010. Thus, we are "required to weigh this evidence [of activity of preparing and filing the application] by application of a rule of reason over the course of the entire critical period." Id. at 1010-11.

The principle of "rearrangement of the parts" finds its roots in In re Japikse, 181 F.2d 1019, 1023 (CCPA 1950). There, claims were held unpatentable because rearranging the position of a starting switch would not have modified the operation of the device. Id. But, Japikse does not stand for a per se rule of obviousness simply through rearrangement of individual parts nor does it displace the requirement of an articulated reason to support the proposed modification. See In re Fritch, 972 F.2d 1260, 1266 (Fed. Cir. 1992).

The Examiner further stated that the claimed invention would have been obvious because “[s]hifting Rosenbaum’s magnets onto his wheels would have not modified the operation of his device.” Id. at 7, 24 (citing In re Japikse, 181 F.2d 1019 (CCPA 1950)).

Appellants argue that “the Examiner has failed to show in the references or elsewhere why such modifications and combinations would be made as he has proposed” and that the Examiner is engaging in impermissible hindsight reconstruction of the claimed invention. Br. 14; id. at 12 (arguing the motivation provided by the Examiner to modify Rosenbaum with the teachings of Burrows are “mere conclusory statements that do not comply with [KSR Int’l Co. v. Teleflex Inc., 550 U.S. 398 (2007)]”).

The Examiner argues that these missing elements would have been obvious to a person of ordinary skill in the art. Ans. 12-13. In support of this argument, the Examiner cites In re Japikse, 181 F.2d 1019 (CCPA 1950).

The Examiner’s reliance on Japikse is misplaced. The Examiner cites that case as standing for the broad proposition that “shifting the position of a particular element is unpatentable as long as the operation of the device is not modified.” Ans. 12. This is too broad a reading of the case. Japikse involved an obviousness rejection where the only difference between the claimed invention and a single reference was the location of a starting switch. Japikse, 181 F.2d at 1023. This case involves multiple differences between the claimed invention and a combination of references.

In essence, the Examiner is attempting to create a per se rule of upatentability as a substitute for the detailed inquiry required by § 103. Reliance on such per se rules is legal error. In re Ochiai, 71 F.3d 1565, 1570 (Fed. Cir. 1995).

It may be that the Federal Circuit would not interpret claim 9 to require an efficacy requirement in cancer treatment, but in Montgomery the Court found that “efficacy is inherent in carrying out the claim steps. In re Montgomery, 677 F.3d 1375, 1381 (Fed. Cir. 2012). Montgomery also teaches that even if the prior art “merely proposed the administration of [an active agent] for treatment or prevention of [a disease] (without actually doing so), it would still anticipate.” Id. at 1382.
