This appeal returns to us following a remand by the U.S. Court of Appeals for the Federal Circuit. ... The Court of Appeals concluded that this finding was not supported by substantial evidence, because the same declaration on which we depended “expressly stated that there is no general correlation between the Basket and Paddle Methods and cited prior art literature that supported this conclusion.” In re Huai-Hung Kao, 639 F.3d 1057, 1067 (Fed. Cir. 2010). The court vacated our decision and remanded “so that the Board can consider whether, under the proper analysis, the evidence of record is sufficient to maintain an obviousness rejection.” Id.

The application was remanded to the Examiner so that five questions could be addressed (Remand Order, Jan. 3, 2012). The Examiner provided a response to the questions (mailed April 16, 2012), as did Appellants (received May 16, 2012).

After considering the evidence of record anew, in light of the guidance provided by the Court of Appeals, we conclude that the Examiner has not provided evidence sufficient to support a prima facie case of obviousness.

The written description requirement obliges an applicant to “convey with reasonable clarity to those skilled in the art that, as of the filing date sought, he or she was in possession of the invention. The invention is, for purposes of the ‘written description’ inquiry, whatever is now claimed.” Vas-Cath Inc. v. Mahurkar, 935 F.2d 1555, 1563 (Fed. Cir. 1991).

Thus, where an applicant had, by amendment, inserted into an application a claim to a specific chemical compound encompassed by the specification’s generic disclosure, our reviewing court’s predecessor found that the specification failed to describe the compound as being part of the invention because the specification lacked sufficient “blaze marks” to guide a skilled practitioner to the claimed compound from the broader disclosure. In re Ruschig, 379 F.2d 990, 995 (CCPA 1967).

Consistent with the blaze marks directive, in addressing the issue of incorporation by reference, the Federal Circuit has stated that the “host document must identify with detailed particularity what specific material it incorporates and clearly indicate where that material is found in the various documents.” Zenon Environmental, Inc. v. U.S. Filter Corp., 506 F.3d 1370, 1378 (Fed. Cir. 2007) (citing Cook Biotech Inc. v. Acell, Inc., 460 F.3d 1365, 1376 (Fed. Cir. 2006)).

In Centocor, the Court addressed Example 13 of the USPTO written description guidelines. The Court found that the “PTO guidelines conclude that characterization of the protein alone may be sufficient under circumstances where 'one of skill in the art would have recognized that the disclosure of the adequately described [protein] X put the applicant in possession of antibodies which bind to [protein] X.'” Centocor Ortho Biotech, Inc. v. Abbott Laboratories, 636 F.3d 1341, 1351 (Fed. Cir 2011).

Centocor distinguished the USPTO written description guideline situation, where the claim simply required binding an antigen, from the more complicated situation where specific properties beyond simply binding of antigen by the antibody are required. Id. at 1352.

We also are not persuaded by Appellant‟s reliance on Doyle. Doyle found that the case involved “a matter of first impression: whether failure to present a so-called linking claim, a claim broad enough to read on—or link—two or more groups of claims subject to a restriction requirement, is an error correctable by reissue” laid out by the Court of Customs and Patent Appeals. In re Doyle, 293 F.3d 1355, 1358 (Fed. Cir. 2002).

In Doyle, the Court found that

it was crucial that the applicant explicitly agreed to the requirement of independent prosecution of the disputed claims (or claims substantially similar to the disputed claims) in a divisional, and not as a part of the application directed towards the elected group. When the applicants returned in reissue seeking to add the disputed claims, the examiner, the Board, and this court rightly held them to the terms of their original agreements. The case is different where, as here, the applicant never asserted the reissue claims or anything similar to them in his original application, and also never agreed to prosecute the reissue claims in a divisional application.

Doyle, 293 F.3d at 1360. The instant facts track much more closely to Orita than to Doyle. In Doyle, there was a linking claim that was broader than all of the original claims and encompassed both groups. Id. at 1358. In this case however, no linking claim was filed.
