“In determining whether a justiciable controversy is present, the analysis must be calibrated to the particular facts of each case.” Matthews Int’l Corp. v. Biosafe Eng’g, LLC, 695 F.3d 1322, 1328 (Fed. Cir. 2012). Although there is no bright-line rule applicable to patent cases, we have held that “Article III jurisdiction may be met where the patentee takes a position that puts the declaratory judgment plaintiff in the position of either pursuing arguably illegal behavior or abandoning that which he claims a right to do.” SanDisk Corp. v. STMicroelectronics, Inc., 480 F.3d 1372, 1380–81 (Fed. Cir. 2007). A reasonable apprehension of suit is not necessary. Id. However, “jurisdiction generally will not arise merely on the basis that a party learns of the existence of a patent owned by another or even perceives such a patent to pose a risk of infringement.” Id. Thus, the question in this case is not whether the appellants’ subjective fear of suit by Monsanto is genuine, but whether they have demonstrated a “‘substantial risk’ that the harm will occur, which may prompt [them] to reasonably incur costs to mitigate or avoid that harm.” See Clapper v. Amnesty Int’l USA, 568 U.S. ___, ___, 133 S.Ct. 1138, 1150 n.5 (2013) (quoting Monsanto Co. v. Geertson Seed Farms, 561 U.S. ___, ___, 130 S.Ct. 2743, 2754–55 (2010)).

When the only distinguishing factor between a method and the prior art is the nature of information being manipulated, the invention is not patentable unless the information has a “new and unobvious functional relationship” with the otherwise known method. See King Pharm., Inc. v. Eon Labs, Inc., 616 F.3d 1267, 1279 (Fed. Cir. 2010) (quoting In re Ngai, 367 F.3d 1336, 1338 (Fed. Cir. 2004)). For example, if the invention is no more than using a computer to facilitate manipulating information that previously would have been manipulated by less efficient means (e.g., manually), “the nature of the information being manipulated does not lend patentability to an otherwise unpatentable computer-implemented product or process.” Ex partes Nehls, 88 USPQ2d 1883, 1889 (BPAI 2008) (precedential). Similarly, a limitation that merely informs a user of the benefits of performing the remainder of the method is not functional. See King Pharm., 616 F.3d at 1279; In re Huai-Hung Kao, 639 F.3d 1057, 1072-73 (Fed. Cir. 2011). Cf. “[The Federal Circuit’s] case law holds that the deliberate action of an inventor or attorney during prosecution generally fails to qualify as a correctable error under § 251.” In re Serenkin, 479 F.3d 1359, 1362 (Fed. Cir. 2007) (holding that Serenkin cannot rely on the reissue statute, in light of a belated decision that he should have retained the original filing date, in order to undo the consequences of his attorney’s deliberate choice of selecting the drawings over the original international filing date in response to the PCT examiner’s requirement).

In a recent decision, the Federal Circuit held that 35 U.S.C. § 251 cannot be used to withdraw a terminal disclaimer from an issued patent. In re Yamazaki, 702 F.3d 1327, 1333 (Fed. Cir. 2012). In Yamazaki, the Patentee attempted to extend the term of the original patent by removing the terminal disclaimer that the Patentee inadvertently failed to have withdrawn prior to issuance of the patent. Id. The court in Yamazaki held that the “term of the original patent” is set at the time of issuance so that the Office is not permitted under 35 U.S.C. § 251 to reissue a patent for a longer term. Id.
