We note Appellants are not precluded from amending the claims toovercome the rejection. Relevant guidance is in the 1351 Off. Gaz. Pat.Office 212 (“A claim drawn to such a computer readable medium that covers both transitory and non-transitory embodiments may be amended to narrow the claim to cover only statutory embodiments to avoid a rejection under 35 U.S.C. § 101 by adding the limitation ‘non-transitory’ to the claim.”); USPTO, Evaluating Subject Matter Eligibility Under 35 U.S.C. § 101 (August 2012 Update) (pp. 11-14), available at http://www.uspto.gov/patents/law/exam/101_training_aug2012.pdf (noting that while “non-transitory” is a viable option for overcoming the presumption that the media encompass signals or carrier waves, merely indicating that such media are “physical” or “tangible” will not overcome such presumption) (emphasis added). Marche is silent regarding any teaching of a pivotal support and we have recently been instructed that
indicating that a prior device could perform as claimed without also indicating “whether it was obvious to modify” the prior device to do so, is indicative that the Examiner has not “met his initial burden of establishing a case of prima facie obviousness.” In re Giannelli, 739 F.3d 1375, 1380 (Fed. Appellants characterize their argument as being that Gysling and Small teach away from the proposed combination. (App. Br. 5.) The substance of Appellants’ argument, however, is directed to the question of whether a person of ordinary skill in the art would have had a reasonable expectation that the teachings of the two references could be combined successfully. Such an expectation is a necessary part of a prima facie case of obviousness. In re Vaeck, 947 F.2d 488, 493 (Fed. Cir. 1991).

Notably,

[A] given course of action often has simultaneous advantages and disadvantages, and this does not necessarily obviate motivation to combine. See [Winner Int'l Royalty Corp. v. Wang, 202 F.3d 1340, 1349 n. 8 (Fed. Cir. 2000)] (“The fact that the motivating benefit comes at the expense of another benefit, however, should not nullify its use as a basis to modify the disclosure of one reference with the teachings of another. Instead, the benefits, both lost and gained, should be weighed against one another.”).

In applying a broadest reasonable interpretation standard, the Federal Circuit had recognized that a statement in a specification that a claim term "refers to" something can serve as a limitation.  See In re Rambus, 694 F.3d 42, 45-47 (Fed. Cir. 2012) (construing term "memory device" based on specification's disclosure that "[i]n general, each teaching of this invention which refers to a memory device can be practiced using a tranceiver device and one or more memory devices"); see also In re Abbott Diabetes Care Inc., 696 F.3d 1142, 1150 (Fed. Cir. 2012) (recognizing that "[e]ven when guidance is not provided in a explicit definitional format, the specification may define claim terms by implication such that the meaning may be found in or ascertained by a reading of the patent documents").

Therefore, the “reentry” step of Pathiyal is omitted in the claim 1 method, but the function of outputting a list is retained by claim 1. “While it may often be true that the mere omission of an element together with its function does not produce a patentable invention, it may also be unobvious to omit an element while retaining its function.” In re Edge, 359 F.2d 896, 899 (CCPA 1966). Finally, we are not persuaded of error by Owner’s argument based upon American Calcar, Inc. v. American Honda Motor Co., Inc., 651 F.3d 1318, 1340 (Fed. Cir. 2011), to show that “in response to” requires an automatic action without user interaction. Appeal Brief 25. The Federal Circuit’s decision in American
Calcar, Inc. v. American Honda Motor Co., Inc. involves a district court’s claim construction which is not based upon the broadest reasonable interpretation standard, and is based upon the disclosure in particular to that case. As such, the holding does not have direct bearing on the case currently before us. Thus, we concur with the Examiner’s interpretation of the limitation “generating . . . in response to the display of [the] first segment” to be such that there is a causal relationship between the first and second segments, but not limited to the generation being automatic and without user interaction.

In assessing the probative value of an expert opinion, we must consider three factors: 1) the interest of
the expert in the outcome of the case, 2) the presence or absence of factual support for the expert’s opinion, and 3) the strength of any opposing evidence. Ashland Oil, Inc. v. Delta Resins & Refractories, Inc., 776 F.2d 281 (Fed. Cir. 1985).
