Applicant's attack on Blasius is reminiscent of the unsuccessful attack made by the applicant in In re Keller, 642 F.2d 413, 426 (CCPA 1981) (one cannot show nonobviousness by attacking individual references where a combination of references is used to support rejection).  Blasius describes an improvement chain extender said to be useful in a variety of polymers, one of which is polyesters. There was no need for Blasius to describe in detail any prior art esters. Carnegie Steel Co. v. Cambria Iron Co., 185 U.S. 403, 437 (1902) (an inventor may assume that what was already known in the art was known to those skilled in the art); Webster Loom Co. v. Higgins, 105 U.S. 580, 586 (1881) (in describing its invention, an applicant may begin at the point where his invention begins, and describe what he has made that is new, and what it replaces of the old. That which is common and well known is as if it were written out in the [specification] patent and delineated in the drawings.)

Because the hallmark of anticipation is prior invention, the prior art reference - in order to anticipate under 35 U.S.C. 102 - must not only disclose all elements of the claim within the four corners of the document, but must also disclose those elements "arranged as in the claim."  Connell v. Sears, Roebuck & Co., 722 F.2d 1542, 1548 (Fed. Cir. 1983).  As appellants explain, Examiners failed to establish an evidentiary basis on this record to support the finding that Matyas teaches "that there can or should be a gap between the cover and the infusion device" (Br. 11 (emphasis removed)).

Although extrinsic evidence will not substitute for a basic enabling disclosure, it can be used to show what was well known in the art or prove that undue experimentation was not required. Precedent teaches that a negative result of prior art compositions obtained by a party having an interest can raise credibility doubts as to the result reported. A module is an undefined structure that does not inform one of ordinary skill in the art what structure, material, or acts perform the claimed function.  Nor does a "computer processor" provide the requisite structure.  Our reviewing court has made clear that the corresponding structure for performing a specific function is required to be more than a simple general purpose computer or microprocessor.  See, e.g., Aristocrat Techs. Australia Pty Ltd. v. Int'l Game Tech., 521 F.3d 1328, 1333 (Fed. Cir. 2008).  To claim a means for performing a specific computer-implemented function, and then to disclose only a general purpose computer or microprocessor as the structure designed to perform that function, amounts to pure functional claiming.  Id.  The structure corresponding to the means for a computer implemented function must include the algorithm needed to transform the general purpose computer or microprocessor disclosed in the specification.  Id.  Here, Appellants merely refer to modules that may include a computer processor but do not disclose any algorithm for performing the claimed function.
