The Supreme Court set forth a framework for distinguishing patents that claim laws of nature, natural phenomena, and abstract ideas from those that claim patent-eligible applications of those concepts. First, [] determine whether the claims at issue are directed to one of those patent-ineligible concepts. [] If so, we then ask, "[ w ]hat else is there in the claims before us? [] To answer that question, [] consider the elements of each claim both individually and "as an ordered combination" to determine whether the additional elements "transform the nature of the claim" into a patent-eligible application. [The Court] described step two of this analysis as a search for an "'inventive concept'"-i.e., an element or combination of elements that is "sufficient to ensure that the patent in practice amounts to significantly more than a patent upon the [ineligible concept] itself."

When a dependent claim is determined to be obvious, the broader claim from which it depends necessarily is also obvious. See Soverain Software LLC v. Victoria's Secret Direct Brand Mgmt., 778 F.3d 1311, 1315 (Fed. Cir. 2015); Ormco Corp. v. Align Tech., Inc., 498 F.3d 1307, 1319 (Fed. Cir. 2007).

A prima facie case of obviousness also may be shown by identifying "adequate support in the prior art" for changing the structure of the prior art compound. Procter & Gamble Co. v. Teva Pharms. USA, Inc., 566 F.3d 989, 995 (Fed. Cir. 2009) (citing In re Grabiak, 769 F.2d 729, 731-32 (Fed. Cir. 1985)).

As to the functional equivalents rationale, that the prior art may disclose structure that performs the same or a similar function as the recited structure does not necessarily demonstrate that the prior art satisfies a structural limitation, such as the "stub tube" limitations. See In re Ruskin, 347 F.2d 843, 847 (CCPA 1965) (reversing an anticipation rejection based on an error "in finding merely functionally equivalent structure to anticipate the specific structure claimed")
