We agree with Appellant that an appropriate definition of “residual,” in the context of the claim language and in light of Appellant’s Specification, is “remaining.”

For the foregoing reasons, Appellant’s argument that Kimmet does not teach an “edge lit panel” is not persuasive of error in the Examiner’s rejection of claim 1. Appellant’s additional arguments relating to claim 1 and the remaining claims are similarly not persuasive of error. Accordingly, I would affirm the Examiner’s rejections.
The word “persuasive” is not meant to suggest Appellant bears the ultimate burden of proving patentability. “After evidence or argument is submitted by the applicant in response [to a prima facie case of unpatentability], patentability is determined on the totality of the record, by a preponderance of evidence with due consideration to persuasiveness of argument.” In re Oetiker, 977 F.2d 1443, 1445 (Fed. Cir. 1992) (emphasis added); see also id. at 1445—46 (“The Board explained why it was unpersuaded by [Appellant’s] arguments on appeal. We discern no irregularity in the procedure.”). My conclusion “was reached after careful consideration of the appealed claims, the evidence of obviousness relied upon by the examiner and the arguments advanced by the appellant and the examiner.” Id. at 1445 (internal quotation omitted).

To be sure, original claims are part of the Specification, and, in many cases, will satisfy the written description requirement. Crown Packaging Tech., Inc. v. Ball Metal Beverage Container Corp., 635 F.3d 1373, 1380 (Fed. Cir. 2011) (citing Ariad, 598 F.3d at 1349). But here, while original independent claims 21, 27, and 33 recited, in pertinent part, tracking actual payments of royalties paid by licensees according to respective schedules in the license agreement, the original claims did not recite the particular comparison and notification steps as now claimed. That original claims 21, 27, and 33 were later amended on March 18, 2013 to add these specific steps is telling in this regard.
Ariad Pharms., Inc. v. Eli Lilly & Co., 598 F.3d 1336, 94 USPQ2d 1161 (Fed. Cir. 2010)(en banc) 2161 , 2161.01 , 2163 , 2163.03 , 2173.05(g) , 2181

We acknowledge that the lack of an antecedent basis for a claim term does not always render a claim indefinite. Bose Corp. v. JBL, Inc., 274 F.3d 1354, 1359 (Fed. Cir. 2001). In this case, however, the term is unclear because the waveguide of claim 1 is not clearly limited to any particular geometry.
