"The fact that the motivating benefit comes at the expense of another benefit, however, should not nullify its use as a basis to modify the disclosure of one reference with the teachings of another. Relying on In re Kerkhoven, 626 F.2d 846 (CCPA 1980), the Examiner concludes that, “[i]n view of the mutual anticorrosive properties of the additives in Sako al. [sic] and those of Sinko et al., it would have been obvious to one of ordinary skill in the art to combine them to form a third composition.” Ans. 4.

After reviewing Sako and Sinko, we conclude that the Examiner’s reliance on Kerkhoven is misplaced. In that case, claims directed to a mixture of spray-dried anionic and spray-dried nonionic surfactants were held to be prima facie obvious in view of prior art describing the each of the surfactants in a spray-dried form. Kerkhoven, 626 F.2d at 850 (“In the case at bar, [the] appealed claims . . . require no more than the mixing together of two conventional spray-dried detergents. Thus, these claims set forth prima facie obvious subject matter.”).


In this case, however, the Examiner’s rejection is not based a simple mixture of Sako’s corrosion-inhibiting surface treatment and Sinko’s corrosion-inhibiting organic-inorganic hybrid composite.

The Examiner contends that, according to In re Dulberg, 289 F.2d 522 (CCPA 1961), “constructing a formerly integral structure [into] various elements involves only routine skill in the art.” (Final Act. 6–7.)

We are persuaded by the Appellants’ argument that the Examiner does not establish why one of ordinary skill in the art would have an apparent reason to cut Lu’s rubber pad into separate parts. (See Appeal Br. 18–25.) In the Dulberg case cited by the Examiner, the claimed lipstick holder had a removable cap. (Dulberg, 289 F.2d at 523.) The court held that “[i]f it were considered desirable for any reason” to allow access to the capped area of the prior art lipstick holder, “it would be obvious to make the cap removable for that purpose.” ( Id. at 523 (emphases added).) Here, the Examiner does not explain, sufficiently, why it would be “considered desirable for any reason” to cut Lu’s rubber pad into separate pieces.

In essence, Appellant argues that the illustrations functionally interrelate with the mat because they represent instructions for using the mat to carry out inspection and cleaning. Yet the Federal Circuit’s precedents have “foreclosed the argument that simply adding new instructions to a known product creates the functional relationship necessary to distinguish the product from the prior art.” AstraZeneca LP v. Apotex Inc., 633 F.3d 1042, 1065 (Fed. Cir. 2010) (citing In re Ngai, 367 F.3d 1336, 1339 (Fed. Cir. 2004)). In Ngai, the court found that, in a kit claim, recited instructions for using the kit were not entitled to patentable weight because “the printed matter in no way depends on the kit, and the kit does not depend on the printed matter. All that the printed matter does is teach a new use for an existing product.” Ngai, 367 F.3d at 1339. Likewise, here, the illustrations on the mat do not depend on the mat, and the mat does not depend on the illustrations. The illustrations simply convey information to a user about cleaning and inspection operations that can be carried out on the mat.

“The rationale behind [the printed matter] line of cases is preventing the indefinite patenting of known products by the simple inclusion of novel, yet functionally unrelated limitations.” King Pharm., 616 F.3d at 1279 (Fed. Cir. 2010); see also Ngai, 367 F.3d at 1339 (“If we were to adopt Ngai’s position, anyone could continue patenting a product indefinitely provided that they add a new instruction sheet to the product.”). In this case, permitting Appellant to distinguish the prior art based on the contents of the illustrations appearing on the mat would allow continued patenting of a known product by the mere inclusion of novel non-functional descriptive material.
