 Appellants rely on the Specification describing “the claimed patterns as ‘vectors’ where a sequence of zeros and ones indicates whether a frame is dropped in that pattern.” Reply Br. 5. But such vectors “are all couched in terms of specific embodiments, not general requirements of the invention.” Veritas Techs. LLC v. Veeam Software Corp., 835 F.3d 1406, 1412 (Fed. Cir. 2016). “[Although the specification often describes very specific embodiments of the invention, we have repeatedly warned against confining the claims to those embodiments.” Phillips v.  "When different words or phrases are used in separate claims, a difference in meaning is presumed." Nystrom v. TREX Co., Inc., 424 F.3d 1136, 1143 (Fed. Cir. 2005). Under the doctrine of claim differentiation, "the presence of a dependent claim that adds a particular limitation gives rise to a presumption that the limitation in question is not present in the independent claim." Phillips v. AWH Corp, 415 F.3d 1303, 1315 (Fed. Cir. 2005) (en banc). This presumption is "especially strong when the limitation in dispute is the only meaningful difference between an independent and dependent claim, and one party is urging that the limitation in the dependent claim should be read into the independent claim." SunRace Roots Enterprise Co., Ltd. v. SRAM Corp., 336 F.3d 1298, 1303 (Fed. Cir. 2003).

Essentially, Appellants are asking us to import a limitation from the Specification into the claim. Our reviewing court has repeatedly cautioned lower courts against limiting the claimed invention to preferred embodiments or specific examples in the specification. Teleflex, Inc. v. Ficosa North America Corp., 299 F.3d 1313, 1328 (Fed. Cir. 2002).

[T]he line between construing terms and importing limitations can be discerned with reasonable certainty and predictability if the court's focus remains on understanding how a person of ordinary skill in the art would understand the claim terms. For instance, although the specification often describes very specific embodiments of the invention, we have repeatedly warned against confining the claims to those embodiments ... In particular, we have expressly rejected the contention that if a patent describes only a single embodiment, the claims of the patent must be construed as being limited to that embodiment. 


Phillips v. AWH Corp., 415 F.3d 1303, 1323 (Fed. Cir. 2005). Phillips counsels us that, upon reading the specification in the context of teaching a person of ordinary skill in the art to make or use the invention, it will become clear whether the specification is setting out specific examples of the invention to accomplish the goal of teaching or whether the specification and claims, instead, are intended to be coextensive. Id. Based on our review of the Specification, we are of the opinion that the teaching of paragraphs 19-20 is merely exemplary and not limiting.

However, Specification paragraph 9 states "the noted plurality of drawings [are] by way of non-limiting examples" (emphasis added). Therefore, it would be improper to use the drawings to limit the definition of the "virtual power delivery network" as Appellants have argued. "[A]lthough the specification often describes very specific embodiments of the invention, we have repeatedly warned against confining the claims to those embodiments. .  [C]laims may embrace different subject matter than is illustrated in the specific embodiments in the specification." Phillips v. AWH Corp., 415 F.3d 1303, 1323 (Fed. Cir. 2005) (en banc) (citations and internal quotation marks omitted). Rather, "[i]t is the claims that measure the invention." SRI Int'l v. Matsushita Elec. Corp. of Am., 775 F.2d 1107, 1121 (Fed. Cir. 1985) (en banc) (citations omitted).

Under the doctrine of claim differentiation, "the presence of a dependent claim that adds a particular limitation gives rise to a presumption that the limitation in question is not present in the independent claim." Phillips v. AWH Corp, 415 F.3d 1303, 1315 (Fed. Cir. 2005). This presumption is "especially strong when the limitation in dispute is the only meaningful difference between an independent and dependent claim, and one party is urging that the limitation in the dependent claim should be read into the independent claim." Unlike the two newly-cited Abdelatti Ali and Ikeda patent documents, which we refuse to consider, we will consider the two dictionary definitions. See 37 C.F.R. § 41.30 (“Evidence means something (including testimony, documents and tangible objects) that tends to prove or disprove the existence of an alleged fact, except that for the purpose of this subpart Evidence does not include dictionaries, which may be cited before the Board.” See also the explanatory comments regarding new Rule § 41.30 (2011): 

Final Bd.R. 41.30 adopts the definition of ‘‘Evidence’’ from Black’s Law Dictionary to provide clarity regarding the use of that term in Subpart B. Toward that end, final Bd.R. 41.30 makes clear that for the purposes of Subpart B, ‘‘Evidence’’ does not encompass dictionaries. Excluding dictionaries from the definition of ‘‘Evidence’’ thus allows appellants to refer to dictionaries in their briefs, which would otherwise be precluded under final Bd.R. 41.33(d)(2) (absent existence of one of the enumerated exceptions). It further allows examiners to refer to dictionaries in the examiner’s answers without automatically rendering a rejection a new ground under final Bd.R. 41.39(a)(2). Treating dictionaries in this manner is consistent with Supreme Court and Federal Circuit precedent, which contemplate that such materials may be consulted by tribunals “at any time.” See, e.g., Nix v. Hedden, 149 U.S. 304, 307 (1893) (citations omitted) (admitting dictionaries to understand the ordinary meaning of terms “not as evidence, but only as aids to the memory and understanding of the court”); Phillips v. AWH Corp., 415 F.3d 1303, 1322–23 (Fed. Cir. 2005) (en banc) (“[J]udges are free to consult dictionaries and technical treatises at any time in order to better understand the underlying technology and may also rely on dictionary definitions when construing claim terms, so long as the dictionary definition does not contradict any definition found in or ascertained by a reading of the patent documents.”) (citation omitted); In re Boon, 439 F.2d 724, 727–28 (CCPA 1971) (holding citation to dictionary was not tantamount to the assertion of a new ground of rejection “where such a reference is a standard work, cited only to support a fact judicially noticed and, as here, the fact so noticed plays a minor role, serving only to fill in the gaps which might exist in the evidentiary showing made by the Examiner to support a particular ground for rejection.” (emphasis and internal quotations omitted)). Thus, the Office feels it is logical to permit the applicant and examiner to submit them to the Board during the briefing stage.

Having carefully considered the Specification and Appellants’ arguments, we find no clear requirement that added calibrant is excluded. Our reviewing Court has “repeatedly held that the fact that the specification describes only a single embodiment, standing alone, is insufficient to limit
otherwise broad claim language.” Howmedica Osteonics Corp. v. Wright Med. Tech., Inc., 540 F.3d 1337, 1345 (Fed. Cir. 2008) (declining to impute a limitation into a disputed claim term in the absence of a clear requirement in the specification, even where “every disclosure of [the disputed term] in the specification shows [the alleged limitation]”); see also Phillips v. AWH Corp., 415 F.3d 1303, 1323 (Fed. Cir. 2005) (“[W]e have expressly rejected the contention that if a patent describes only a single embodiment, the claims of the patent must be construed as being limited to that embodiment.”).
