“Having established that this knowledge was in the art, the [E]xaminer could then properly rely . . . on a conclusion of obviousness ‘from common knowledge and common sense of the person of ordinary skill in the art without any specific hint or suggestion in a particular reference.’” In re Bozek, 416 F.2d 1385, 1390 (CCPA 1969). It is the Appellants’ burden to traverse the Examiner’s notice. “We did not mean to imply . . . that a bald challenge, with nothing more, would be all that was needed. . . .We feel it to be perfectly consistent with the principles governing procedural due process to require that a challenge to judicial notice by the board contain adequate information or argument so that on its face it creates a reasonable doubt regarding the circumstances justifying the judicial notice.” In re Boon, 439 F.2d 724, 728 (CCPA 1971). That has not been done here by the bald assertion that “the Examiner has erred in taking Official Notice without any substantial evidence” (App. Br. 15).

An examiner’s reasoning “may include recourse to logic, judgment, and common sense available to the person of ordinary skill,” which does “not necessarily require explication in any reference or expert opinion.” See Perfect Web Techs., Inc. v. InfoUSA, Inc., 587 F.3d 1324, 1328-29 (Fed. Cir. 2009); In re Bozek, 416 F.2d 1385, 1390 (CCPA 1969) (examiner may rely on “common knowledge and common sense of the person of ordinary skill in the art without any specific hint or suggestion in a particular reference”). However, “the mere recitation of the words ‘common sense’ without any support adds nothing to the obviousness equation.” Mintz v. Dietz & Watson, Inc., 679 F.3d 1372, 1377 (Fed. Cir. 2012).

Appellants‟ claim language uses the phrase “substantially aligned”. “When a word of degree is used [it is necessary to] determine whether the… specification provides some standard for measuring that degree.” See Seattle Box Co.. v. We find that nothing in Appellants‟ Specification, except for Appellants‟ own drawings, for providing some standard for measuring that degree. Printed matter may patentably distinguish a claimed invention from the prior art when the critical question of whether there is a new and unobvious functional relationship between the printed matter and the substrate is answered in the affirmative. To show a new and unobvious functional relationship, it has to be shown that the printed matter would not achieve its purpose without the substrate and the substrate without the printed matter would similarly be unable to produce the desired result.
