The first sentence of the paragraph highlight by Appellant provides: “In accordance with an exemplary embodiment of the invention, fuel regulator system 39 includes both the primary and secondary regulators, or a custom single regulator, but in any case is located remotely, or off-board, from dual fuel generator 20.” Spec. ¶ 25 (emphasis added). We view the use of “or” in this passage—similar to the use of “i.e.”—as clearly setting forth a definition of the term “off-board,” as well as expressing an intent to explain the use of that term. See Luminara Worldwide, LLC v. Liown Elecs. Co., 814 F.3d 1343, 1353 (Fed. Cir. 2016) (“To act as a lexicographer, a patentee must ‘clearly set forth a definition of the disputed claim term’ and ‘clearly express an intent to redefine the term.’” (quoting Thorner v. Sony Computer Entm’t Am. LLC, 669 F.3d 1362, 1365 (Fed. Cir. 2012))); Edwards Lifesciences LLC v. Cook Inc., 582 F.3d 1322, 1334 (Fed. Cir. 2009) (“[U]se of ‘i.e.’ signals an intent to define the word to which it refers.”).

Although the Examiner is directed to give a claim term its broadest reasonable interpretation, the interpretation must be consistent with: (1) the ordinary and customary meaning of the term (unless the term has been given a special definition in the specification); (2) the use of the claim term in the specification and drawings; and (3) the interpretation that those skilled in the art would reach. See In re Cortright, 165 F.3d 1353, 1359 (Fed. Cir. 1999).

Generally, claim terms are:

Given their ordinary and customary meaning as understood by a person of ordinary skill in the art when
read in the context of the specification and prosecution history. There are only two exceptions to this general
rule: 1) when a patentee sets out a definition and acts as his own lexicographer, or 2) when the patentee disavows the full scope of a claim term either in the specification or during prosecution.

[Thorner v. Sony Computer Entm’t Am. LLC, 669 F.3d 1362, 1365 (Fed. Cir. 2012)] (citation omitted). “To act as its own lexicographer, a patentee must ‘clearly set forth a definition of the disputed claim term’ other than its plain and ordinary meaning.” Id. at 1365 (quoting CCS Fitness, Inc. v. Brunswick Corp., 288 F.3d 1359, 1366 . . . (Fed. Cir. 2002)). “It is not enough for a patentee to simply disclose a single embodiment or use a word in the same manner in all embodiments, the patentee must ‘clearly express an intent’ to redefine the term.” Id. (citing Helmsderfer v. Bobrick Washroom Equip., Inc., 527 F.3d 1379, 1381 . . . (Fed. Cir. 2008)).

We find such “configured to” language merely represents a statement of intended use of the RFID readers comprised in the network, which does not limit the claim. Additionally, we find the recited “to be deployed” language merely represents a statement of intended use of the equipment, which does not limit the claim (Claim 1). Particularly, an intended use will not limit the scope of the claim because it merely defines a context in which the invention operates. Boehringer Ingelheim Vetmedica, Inc. v. Schering-Plough Corp., 320 F.3d 1339, 1345 (Fed. Cir. 2003). Thus, we give claim 1 its broadest reasonable interpretation as merely requiring RFID readers capable of reading tag identifiers relating to equipment capable of being deployed in a group of fixed locations.

We are also not apprised of Examiner error by Appellant’s argument that the Specification defines “driveably connected” to mean “directly connected.” Our reviewing court has instructed that “[t]o act as its own lexicographer, a patentee must clearly set forth a definition of the disputed claim term other than its plain and ordinary meaning.” Thorner v. Sony Computer Entertainment America LLC, 669 F.3d 1362, 1365-66 (Fed. Cir. 2012) (citations and quotations omitted). Appellant has not pointed to, and we do not see, where the Specification clearly sets forth that “driveably connected” means something other than its plain and ordinary meaning.

Thus, “faux finish” is accorded its ordinary and customary meaning, and no express definition of “faux finish” is necessary to conclude that Appellants failed to overcome the Examiner’s determination that Cymbala discloses the structure as claimed. Our reviewing court has rejected the proposition that, “regardless of how broad, a disclosure of a chemical genus renders obvious any species that happens to fall within it.” In re Jones, 958 F.2d 347, 350 (Fed. Cir. 1992). In Lemin, cited by the majority, the court explained that :

The position of the Patent Office is, essentially, that Lemin has done no more than pluck a subgenus out of a generic disclosure by Jones, and has used that subgenus in precisely the manner taught by Jones.
Generally speaking, there is nothing unobvious in choosing ‘some’ among ‘many’ indiscriminately. Here, however, the choice is based on a discovery by Lemin that some compounds, falling within a prior art genus, have a special significance.

332 F.2d 839, 841 (citation omitted). Moreover, unlike the “multitude [1200] of effective combinations” disclosed by the reference patent in Merck, 874 F.2d at 807, the number of combinations in this case is truly astronomical.

To overcome a prima facie case of obviousness by showing secondary considerations of unexpected results, Appellants must first establish a nexus between the claimed invention and the allegedly unexpected results. See Wyers v. Master Lock Co., 616 F.3d 1231, 1246 (Fed. Cir. 2010) (“For objective evidence of secondary considerations to be accorded substantial weight, its proponent must establish a nexus between the evidence and the merits of the claimed invention.”). “Where the offered secondary consideration actually results from something other than what is both claimed and novel in the claim, there is no nexus to the merits of the claimed invention.” In re Kao, 639 F.3d 1057, 1068 (Fed. Therefore, Appellant attempts to limit the ordinary claim term “message” to exclude packets or other known message formats. However, the Federal Circuit recently reiterated the stringent standard for narrowing a claim term beyond its plain and ordinary meaning in Thorner v. Sony Computer Entertainment America L.L.C., 669 F.3d 1362 (Fed. Cir. 2012). There, we explained that we will only interpret a claim term more narrowly than its ordinary meaning under two circumstances: “1) when a patentee sets out a definition and acts as [its] own lexicographer, or 2) when the patentee disavows the full scope of a claim term either in the specification or during prosecution. Id. at 1365.

To act as its own lexicographer, a patent applicant must clearly set forth a definition of the claim term in question other than its plain and ordinary meaning. Thorner v. Sony Comp.
