1767 Ex Parte Flanigan et al 11160279 - (D) McKELVEY 103 BROOKS KUSHMAN P.C./FGTL SALVITTI, MICHAEL A

We recognize that Inventor Flanigan testified that there is a desire to lessen dependence on fossil fuel polyols. However, that recognition is also taught by Kurth (¶ 0008). Lastly, the evidence will not credibly support a finding that those attempting to solve the long-felt need were aware of the prior art and failed to do so. Toledo Pressed Steel Co. v. Standard Parts, Inc., 307 U.S. 350, 356 (1939) ("[b]ut it does not appear that either was familiar with the relevant prior art"); In re Allen, 324 F.2d 993, 997 (CCPA 1963) (while appellant's arguments imply that there may be been an unsolved problem in the art, an allegation to this effect is not evidence of unobviousness unless it is shown, as was not done here, that [1] the widespread efforts of [2] skilled workers [3] having knowledge of the prior art [4] had failed to find a solution to the problem). Kurth seems to have addressed and solved at least part, if not all, of the problem.

We do not see in these passages any mention of “periodic access.” While the absence of these terms do not necessarily lead to the conclusion that there is inadequate written descriptive support (see “[T]he prior application need not describe the claimed subject matter in exactly the same terms as used in the claims . .

It may be obvious to provide “periodic access to the license-protected broadcast channel,” given a disclosure of repeated attempts by the ST to access license-protected content, but “[o]ne shows that one is “in possession” of the invention by describing the invention, with all its claimed limitations, not that which makes it obvious. ” Lockwood v. The Federal Circuit has repeatedly emphasized that, as a general rule, when an indefinite article, such as “a,” is used with a term in an open-ended claim containing the transitional phrase “comprising,” the article is properly construed to mean “one or more.” See, e.g., Tate Access Floors, Inc. v. Interface Architectural Res., Inc., 279 F.3d 1357, 1370 (Fed. Cir. 2002) (“It is well settled that the term ‘a’ or ‘an’ ordinarily means ‘one or more.”’); KCJ Corp. v. Kinetic Concepts, Inc., 223 F.3d 1351, 1356 (Fed. Cir. 2000).

Under the reissue statute, the PTO “had no power to revoke, cancel, or annul” a previously issued patent unless a reissue proceeding had been initiated by the patentee. McCormick Harvesting Mach. Co. v. C. Aultman & Co., 169 U.S. 606, 612 (1898); see also Patlex Corp. v. Mossinghoff, 758 F.2d 594, 601 (Fed. Cir. 1985). In 1980, Congress authorized ex parte reexamination to address this deficiency in the reissue statute. See Patent Act of 1980, Pub. L. No. 96-517, 94 Stat. 3015 (1980) (codified as amended at 35 U.S.C. §§ 301–307). Like reissuance, ex parte reexamination is a curative proceeding meant to correct or eliminate erroneously granted patents. See In re Etter, 756 F.2d 852, 858 (Fed. Cir. 1985) (en banc); see also In re Freeman, 30 F.3d 1459, 1468 (Fed. Cir. 1994). Congress subsequently enacted additional provisions authorizing the PTO to conduct inter partes reexaminations, and more recently, inter partes review. See Abbott Labs. v. Cordis Corp., 710 F.3d 1318, 1325 (Fed. Cir. 2013) (discussing inter partes reexamination and inter partes review); Leahy-Smith America Invents Act (“AIA”), Pub. L. No. 112-29, § 6(a), 125 Stat. 284, 299–304 (2011) (to be codified at 35 U.S.C. §§ 311–319).

As we recently confirmed, when an alleged infringer “instructs users to use a product in an infringing way, there is sufficient evidence for a jury to find direct infringement.” Toshiba Corp. v. Imation Corp., 681 F.3d 1358, 1366 (Fed. Cir. 2012) (citing Lucent Tech., 580 F.3d at 1318). While a very close call, we find that Convolve presented enough evidence to preclude summary judgment on its inducement claims.
