A change in the principle of operation of the primary reference can, in some circumstances, render a modification nonobvious. Whether a specification complies with the written description requirement of 35 U.S.C. § 112, first paragraph, is a question of fact. Regents of Univ. of Cal. v. Eli Lilly and Co., 119 F.3d 1559, 1566(Fed. Cir. 1997) (citing Vas-Cath Inc. v. Mahurkar, 935 F.2d 1555, 1563 (Fed. Cir. 1991)). The fundamental factual inquiry is whether the specification conveys with reasonable clarity to those skilled in the art that, as of the filing date sought, an applicant was in possession of the invention as now claimed. "[W]hen an inventor tries to distinguish his claims from the prior art by introducing evidence of unexpected 'synergistic' properties, the evidence should at least demonstrate 'an effect greater than the sum of the several effects taken separately.'" Merck & Co., Inc. v. Biocraft Laboratories, Inc., 874 F.2d 804, 808-09 (Fed. Cir. 1989) (quoting Sakraida v. Ag Pro, Inc., 425 U.S. 273, 282 (1976)). The declaration fails to adequately set forth the results for the separate features that one of ordinary skill would have expected and therefore fails to establish a baseline against which to compare the sum of the results. See Shults Supp. Decl., para. 24. Thus, Appellant has not provided sufficient evidence that any improved results due to the "synergistic effects" would have been unexpected to one of ordinary skill in the art as compared to the closest prior art.
