Claim 1 recites three “unit[s]”, the name of each unit (e.g., “a vernacular pronunciation extracting unit”) corresponding to a function to be performed by the “unit” (e.g., “to extract a vernacular pronunciation in response to receipt of a Hanja character string”). These limitations do not include the word “means,” thus, a rebuttable presumption exists these limitations are not means-plus-function limitations. Williamson v. Citrix Online, LLC, 792 F.3d 1339, 1348 (Fed. Cir. 2015). This presumption can be overcome if the limitation “fails to recite sufficiently definite structure or else recites function without reciting sufficient structure for performing that function.” Id. at 1349 (citation and internal quotation marks omitted). Contrary to Appellants argument (Br. 6), the presumption is not a “strong” one.1 As used herein, the term “means for” is replaced by the “nonce word”2 “unit” thereby connoting one or more generic “black boxes” for performing all of the intended functions recited in claim 1.

2 Although termed a “nonce word”, we recognize this characterization is somewhat inaccurate, the common meaning being “a word invented and used for a particular occasion.” Morris, W., The American Heritage Dictionary of the English Language, 892. Houghton Mifflin Company (1981). However, the word “unit” does have a generally accepted meaning including “an entire apparatus or the equipment that performs a specific function.” Id. at 1400. Thus, while not a made-up word, on the present facts the word “unit” at most restricts the preceding functional language to an apparatus but not to a particular structure (cf. “a window-mounted air conditioning unit”). Instead, the word “unit” is merely a transition between a shortened description of a function to be performed (e.g., vernacular pronunciation extracting) and the corresponding full description of that function (e.g., apparatus “to extract a vernacular pronunciation in response to receipt of a Hanja character string”). Thus, as used in claim 1, the term “unit” is a “non-structural generic placeholder” that is tantamount to the term “means” because it fails to connote sufficiently definite structure (i.e., a “nonce word”). We agree with the Examiner that claim 1 is not patent-eligible subject matter. Claim 1 is directed to a peptide that is made up of a fragment of the naturally occurring matriptase protein. Thus, the Supreme Court opinion in Association for Molecular Pathology v. Myriad Genetics, Inc., 133 S.Ct. 2107 (2013), is controlling. In Myriad, the Court considered claims directed to isolated DNA encoding the BRCA1 polypeptide and fragments of at least 15 nucleotides of that DNA. Id. at 2113.
The Court held that “Myriad did not create anything. To be sure, it found an important and useful gene, but separating that gene from its surrounding genetic material is not an act of invention.” Id. at 2117. “Myriad found the location of the BRCA1 and BRCA2 genes, but that discovery, by itself, does not render the BRCA genes ‘new . . . composition[s] of matter,’ § 101, that are patent eligible.” Id. “Nor are Myriad’s claims saved by the fact that isolating DNA from the human genome severs chemical bonds and thereby creates a nonnaturally occurring molecule.” Id. at 2118.

Thus, the Supreme Court opinion in Association for Molecular Pathology v. Myriad Genetics, Inc., 133 S.Ct. 2107 (2013), is controlling. In Myriad, the Court considered claims directed to isolated DNA encoding the BRCA1 polypeptide and fragments of at least 15 nucleotides of that DNA. Id. at 2113.
The Court held that “Myriad did not create anything. To be sure, it found an important and useful gene, but separating that gene from its surrounding genetic material is not an act of invention.” Id. at 2117. “Myriad found the location of the BRCA1 and BRCA2 genes, but that discovery, by itself, does not render the BRCA genes ‘new . . . composition[s] of matter,’ § 101, that are patent eligible.” Id. “Nor are Myriad’s claims saved by the fact that isolating DNA from the human genome severs chemical bonds and thereby creates a nonnaturally occurring molecule.” Id. at 2118.

Further, Appellants argue the Examiner’s collection of screenshots is “insufficient as a matter of law to establish that [the software it is regarding] was known or used by others in this country prior to’ ‘the relevant date of the application.’” App. Br. 5—6 (quoting Hilgraeve, Inc. v. Symantec Corp., Ill F. Supp. 2d 964, 975 (E.D. Mich. 2003)).
We disagree with Appellants. Unlike Hilgraeve which applied the Federal Rules of Evidence in evaluating whether prior art satisfied the “clear and convincing evidence” standard for invalidity in district-court litigation, an Examiner’s rejection is subject to a “preponderance of the evidence” standard and the Federal Rules of Evidence do not apply. In re Epstein, 32 F.3d 1559, 1564 (Fed. Cir. 1994). As noted above, the Examiner found the Microsoft Word 2002 product included features that teach or suggest certain claim limitations, and the Examiner inferred based on the nature of the features and the product’s copyright date that the features are part of the prior art. See Ans. 14; see also Epstein, 32 F.3d at 1567.3
3In his concurring opinion in Epstein, Judge Plager reasoned that it is not the PTO’s responsibility to “know all there is to know about everything” and “[i]t is not unreasonable to expect the applicant to know more about the prior work in the relevant art than the PTO examiner.” Epstein, 32 F.3d at 1570 (Plager, J. and Cowen, Sr.J., concurring). That reasoning seems particularly apt here, as the real party in interest, Microsoft Corporation (App. Br. 3), is also the source of the prior art Microsoft Word 2002 product. Appellants are reminded that “[ejach individual associated with the filing and prosecution of a patent application has a duty of candor and good faith in dealing with the Office, which includes a duty to disclose to the Office all information known to that individual to be material to patentability as defined in this section.” 37 C.F.R. § 1.56 (2012).

“Before considering the rejections . . ., we must first [determine the scope of] the claims . . . .” In re Geerdes, 491 F.2d 1260, 1262 (CCPA 1974). We, therefore, first endeavor to determine what it means to “establish[] a plurality of categories each associated with a unique minimum bandwidth threshold,” as recited in independent claims 1 and 19.
The claim term “category” never appeared in the originally filed Specification, and Appellants’ Specification contains no disclosure of affirmatively establishing categories. See Spec. (as filed Feb. 24, 2010). The term was added to by way of claim amendment. See Amendment and Response Under 37 C.F.R. § 1.111 (filed Mar. 16, 2015). Appellants instead rely on Figures 2–4 of the Specification for support of the claimed act of establishing a plurality of categories. See App. Br. 4–5, 9–10, and 12. As will be explained below, however, the Specification’s disclosure associated with these figures does not support the narrow interpretation of establishing categories that Appellants urge.
