Appellants do not identify any claimed features that would constitute “significantly more” than the abstract idea, in accord with Alice. Furthermore, “[t]he Supreme Court has made clear that the principle of preemption is the basis for the judicial exceptions to patentability” and “[f]or this reason, questions on preemption are inherent in and resolved by the § 101 analysis.” Ariosa Diagnostics, Inc. v. Sequenom, Inc., 788 F.3d 1371, 1379 (Fed. Cir. 2015) (citing Alice, 134 S. Ct. at 2354). Although “preemption may signal patent ineligible subject matter, the absence of complete preemption does not demonstrate patent eligibility.” Id.

Alice Corp. Pty. Ltd. v. CLS Bank Int'l, 573 U.S. _, 134 S. Ct. 2347, 110 USPQ2d 1976 (2014) 2103 2106

We reach this conclusion despite the fact that claim 6 is dependent, and whose sole limitation is conditional. A dependent claim is a claim to the invention of the parent claim with the added feature: it is not a claim to the added feature alone. Natron Corp. v. Schurka U.S.A. Inc., 558 F.3d 1352, 1358 (Fed. Cir. 2009). Therefore, our analysis of a conditional limitation is the same regardless of whether the limitation appears in an independent claim or a dependent claim.

Appellants must establish a nexus between the proffered objective evidence and the merits of the claimed invention for the objective evidence to be accorded substantial weight.  In re Kao, 639 F.3d 1057, 1068 (Fed. Cir. 2011).  “A prima facie case of nexus is made when the patentee shows both that there is commercial success, and that the product that is commercially successful is the invention disclosed and claimed in the patent.”  Crocs, Inc. v. Int’l Trade Comm’n, 598 F.3d 1294, 1310‒11 (Fed. Cir. 2010) (citing In re GPAC Inc., 57 F.3d 1573, 1580 (Fed. Cir. 1995)).  “Where the offered secondary consideration actually results from something other than what is both claimed and novel in the claim, there is no nexus to the merits of the claimed invention.”  Kao, 639 F.3d at 1068.

The correct inquiry in giving a claim term its broadest reasonable interpretation in light of the specification is not whether the specification proscribes or precludes some broad reading of the claim term adopted by the examiner. And it is not simply an interpretation that is not inconsistent with the specification. It is an interpretation that corresponds with what and how the inventor describes his invention in the specification, i.e., an interpretation that is "consistent with the specification." In re Morris, 127 F.3d 1048, 1054 (Fed. A claim can be obvious even where all of the claimed features are not found in specific prior art references, where “there is a showing of a suggestion or motivation to modify the teachings of [the prior art] to the claimed invention.” SIBIA Neurosciences, Inc. v. Cadus Pharm. Corp., 225 F.3d 1349,1356 (Fed. Cir. 2000) (concluding that patent would have been obvious in light of teachings in prior art which provided motivation and suggestion to modify existing techniques to arrive at method in question).

Ormco Corp. v. Align Tech., Inc., 463 F.3d 1299, 1307 (Fed. Cir. 2006).

However, “[e]ven when obviousness is based on a single prior art reference, there must be a showing of a suggestion or motivation to modify the teachings of that reference.” In re Kotzab, 217 F.3d 1365, 1370 (Fed. Cir. 2000).

“The mere fact that the prior art may be modified in the manner suggested by the Examiner does not make the modification obvious unless the prior art suggested the desirability of the modification.” In re Fritch, 972 F.2d 1260, 1266 (Fed. Cir. 1992).
