We agree with the Examiner that the argued limitations noted above, and as set forth in claim 3, are functional limitations. However, although “[a] patent applicant is free to recite features of an apparatus either structurally or functionally,” nonetheless, the Examiner is required “to make sufficient factual findings, such that it can reasonably infer that the prior art product and that of the patent at issue are the same.” Howmedica Osteonics Corp. v. Zimmer Inc., 640 Fed. Appx. 951, 958 (Fed. Cir. 2016). In this case, we agree with Appellants that “[t]he Examiner asserts without factual evidence that Brass discloses” the argued limitations noted above. Appeal Br. 8, 13.

 We cannot agree with the Examiner that one skilled in the art would read Grace ’943 in this manner without the benefit of hindsight. The difference between the type of flexibility discussed in Grace ’943 and that described in the Specification, and recited in the claims, of the present application is a difference in kind and not merely a difference in degree. As a matter of claim construction, however, we conclude that the claimed light encoded to indicate the calibration device’s three-dimensional coordinate position constitutes nonfunctional descriptive material (NFDM), i.e., analogous to printed matter, if the informational content of the data (e.g., “the code indicating the three-dimensional coordinate position of the calibration device” in claim 1) is not positively recited as actually used to change or affect the manner in which a function is performed by a structural element in an apparatus claim, or the manner in which a step or act is performed in a method claim.

“[A] limitation is printed matter only if it claims the content of information.” In re DiStefano, 808 F.3d 845, 848 (Fed. Cir. 2015).

Here, the claimed light codes are analogous to printed matter to the extent they contain informational content (i.e., data) indicating “the three-dimensional coordinate position of the calibration device.” For example, a three-dimensional coordinate position could be written on paper (as printed matter) or emitted (i.e., transmitted) as data by modulating light according to a particular code (NFDM).

The Examiner finds independent claims 60 and 62 are indefinite, because the claims both recite “circuitry for,” but “fail[] to recite the element which performs each step.” ...

Appellants argue the Examiner erred, because the use of the phrase “circuitry for” in claims 60 and 62 does not create a gap between elements in the claims (see Reply Br. 3—5), and “it is not necessary to recite in the claim everything necessary to operate the device.” Reply Br. 6, citing Deering v. Winona, 155 U.S. 286 (1894), and Special Equipment v. Coe, 324 U.S. 370 (1945).

We are persuaded by Appellants’ arguments.

Appellants do not provide any persuasive reasoning or evidence that such an upper surface as depicted in Matsuda that includes tabs is not encompassed by the claim language. For example only, Appellants have not recited that the upper surface is planar and exclusive of any projections/tabs. Cf. Howmedica Osteonics Corp. v. Wright Med. Tech., Inc., 540 F.3d 1337, 1345 (Fed. Cir. 2008) (declining to impute a limitation into a disputed claim term in the absence of a clear requirement in the specification, even where “every disclosure of [the disputed term] in the specification shows [the alleged limitation]”); see also Ventana Med. Sys., Inc. v. BiogenexLabs., Inc., 473 F.3d 1173, 1181 (Fed. Cir. 2006) (“[T]he mere fact that the [asserted] patent discloses [only certain] embodiments . . . does not in and of itself mean that the method claims at issue are limited to the disclosed embodiments.”); Phillips v. It appears to us that the Examiner’s determination of equivalence is rooted in the fact that alumina is listed among several optional components in Dupin, some of which also appear in Nedez to be optional, and to be included in similar amounts to those also disclosed in Dupin. Final Act. 8 citing Dupin 3:42—46; see also id. at 4 (noting how Nedez’s composition “also comprises at least one compound selected from clays, silicates, titanium sulfate and ceramic fibers in a total amount of 30% by weight or less.”). This, without more, is an insufficient basis upon which to determine equivalence. See In re Ruff, 256 F.2d 590, 598—9 (CCPA 1958) (explaining how equivalence cannot be demonstrated by mere existence within a Markush group). Moreover, we note that the Examiner’s attempted reliance on Appellants’ Specification to support a showing of equivalence (Final Act. 9-10) is legally impermissible. See In re Ruff 256 F.2d at 598 (“To rely on an equivalence known only to the applicant to establish obviousness is to assume that his disclosure is a part of the prior art. The mere statement of this proposition reveals its fallaciousness.”).
