The requirement for anticipation that the prior art elements themselves be “arranged as in the claim” means that claims cannot be “treated ... as mere catalogs of separate parts, in disregard of the part-to-part relationships set forth in the claims and that give the claims their meaning.” Lindemann Maschinenfabrik GMBH v. The use of means-plus-function language in a claim does not excuse an appellant from complying with the claim definiteness requirement of 35 U.S.C. § 112, second paragraph. See Ergo Licensing, LLC v. CareFusion 303 LLC, Inc., 673 F.3d 1361 (Fed. Cir. 2012); Noah Sys., Inc. v. Intuit Inc., No. 2011-1390, 2012 WL 1150216 at *7 (Fed. Cir. Apr. 9, 2012). If an Applicant does not disclose structure for a means plus function term, the claim is indefinite. Ergo Licensing, LLC v. CareFusion 303 LLC, Inc., 673 F.3d at 1361.

Appellants additionally argue that Stieber is not prior art because the Examiner is not entitled to use the filing of a provisional application in a §102(e) rejection. App. Br. 27-30. This issue has, since the filing of Appellants’ brief, been addressed in In re Giacomini, 612 F.3d 1380 (Fed. The Examiner sets forth an alternative rationale: that the separation of elements is a design consideration within the skill of the art. Ans. 9 (citing In re Dulberg, 289 F.2d 522 (CCPA 1961)). However, as Appellants point out (Reply Br. 3-4), in Dulberg it was held obvious to make a press fit cap removable because there was a particular reason to make the cap removable: to gain access to the end of the tube upon which the cap was secured. See Dulberg, 289 F.2d at 523. In this case, however, the Examiner has not identified a valid reason to make the first sub-assembly separable from the second. Accordingly, the Examiner’s alternative reasoning is not based on a rational underpinning.

The Federal Circuit has since stated that “inventions with specific applications or improvements to technologies in the marketplace are not likely to be so abstract that they override the statutory language and framework of the Patent Act.” Research Corp. Techs., Inc. v. Microsoft Corp., 627 F.3d 859, 869 (Fed. Cir. 2010).

In CyberSource, the court noted that the method recited in Research Corp. “required the manipulation of computer data structures (e.g., the pixels of a digital image and a two-dimensional array known as a mask) and the output of a modified computer data structure (a halftoned digital image).” CyberSource Corp. v. Retail Decisions, Inc., 654 F.3d 1366, 1376 (Fed. Cir. 2011). The method in that case “could not, as a practical matter, be performed entirely in a human‟s mind.” Id. By contrast, in CyberSource, “one could mentally perform the fraud detection method” recited in the claims and therefore the claims in that case attempted to “capture unpatentable mental processes (i.e., abstract ideas).” Id. at 1376-77.
