1765 Ex Parte Rukavina et al 11638876 - (D) McKELVEY 103 103 41.50 112(2) PPG Industries, Inc. SERGENT, RABON A

Precedent teaches that a negative result of prior art compositions obtained by a party having an interest can raise credibility doubts as to the result reported. See In re Reid, 179 F.2d 998, 1002 (CCPA 1950) (“in no way reflecting on the good faith of the makers of the affidavits . . . the failures of experimenters who have no interest in succeeding should not be accorded great weight”) and In re Michalek, 162 F.2d 229, 232 (CCPA 1947) (same), and compare In re Carroll, 601 F.2d 1184, 1886 (CCPA 1979) (“[u]nlike the usual expert opinion, prepared either by the applicant himself, or on his behalf after the controversy has arisen, Dr. Merkal’s opinion was formulated prior to the making of the claimed invention. It was therefore completely untainted by either hindsight or bias.”).

1631 Ex Parte Leuthardt et al 12460252 - (D) McGRAW 112(2)/103/double patenting INTELLECTUAL VENTURES - ISF HARWARD, SOREN T

A module is an undefined structure that does not inform one of ordinary skill in the art what structure, material, or acts perform the claimed function.  Nor does a "computer processor" provide the requisite structure.  Our reviewing court has made clear that the corresponding structure for performing a specific function is required to be more than a simple general purpose computer or microprocessor.  See, e.g., Aristocrat Techs. Australia Pty Ltd. v. Int'l Game Tech., 521 F.3d 1328, 1333 (Fed. Cir. 2008).  To claim a means for performing a specific computer-implemented function, and then to disclose only a general purpose computer or microprocessor as the structure designed to perform that function, amounts to pure functional claiming.  Id.  The structure corresponding to the means for a computer implemented function must include the algorithm needed to transform the general purpose computer or microprocessor disclosed in the specification.  Id.  Here, Appellants merely refer to modules that may include a computer processor but do not disclose any algorithm for performing the claimed function.

Thus the language is properly construed to functionally limit the shape point rather than merely describe an intended use. Cf. Vizio, Inc. v. Int'l Trade Comm'n, 605 F.3d 1330, 1341 (Fed. Cir. 2010) ("[T]he 'for decoding' language ... is properly construed as a limitation, and not merely a statement of purpose or intended use for the invention, because 'decoding' is the essence or a fundamental characteristic of the claimed invention.").

The Examiner finds that Sugimoto discloses a golf club head having a face portion, wherein the face portion includes a first region and a second region, and wherein the first region "covers up to 50%" of the face portion. Final Act. 2.  The Examiner then cites case law, including Gardner v. TEC Sys., Inc., 725 F.2d 1338 (Fed. Cir. 1984), for the proposition that changes in size or proportions do not impart patentability unless they are "critical." Final Act. 2. ...

The facts in this case are not similar to those in Gardner v. TEC Sys. Inc. - a case in which the claimed dimensions did not cause the claimed device to perform differently than the prior art device.  See Gardner, 725 F.2d at 1349

Having carefully considered the Specification and Appellants’ arguments, we find no clear requirement that added calibrant is excluded. Our reviewing Court has “repeatedly held that the fact that the specification describes only a single embodiment, standing alone, is insufficient to limit
otherwise broad claim language.” Howmedica Osteonics Corp. v. Wright Med. Tech., Inc., 540 F.3d 1337, 1345 (Fed. Cir. 2008) (declining to impute a limitation into a disputed claim term in the absence of a clear requirement in the specification, even where “every disclosure of [the disputed term] in the specification shows [the alleged limitation]”); see also Phillips v. We have considered the Declaration, but do not find it persuasive of establishing patentability of the appealed subject matter. Although factual evidence is preferable to opinion testimony, such testimony is entitled to consideration and some weight so long as the opinion is not on the ultimate legal conclusion at issue. While an opinion as to a legal conclusion is not entitled to any weight, the underlying basis for the opinion may be persuasive. In re Chilowsky, 306 F.2d 908, 916 (CCPA 1962) (expert opinion that an application meets the requirements of 35 U.S.C. § 112 is not entitled to any weight; however, facts supporting a basis for deciding that the specification complies with 35 U.S.C. § 112 are entitled to some weight); In re Lindell, 385 F.2d 453, 456 (CCPA 1967). On this record, Declarant has not directed us to persuasive evidence sufficient to establish that a person of ordinary skill in the art would not have recognized the suitability of using Murakami’s process for graphitizing a SAM as exemplified in Eck.

We find the Examiner’s reasoning to be sufficient to support the finding that Moody I inherently teaches “determining a number” of email messages, as claimed. Although a finding of inherency in the context of obviousness must meet a “high standard,” PAR Pharmaceutical, Inc. v. TWI Pharmaceuticals, Inc., 773 F.3d 1186, 1195 (Fed. Cir. 2014), the Examiner has satisfied it here, as “the limitation at issue necessarily must be present,” id. at 1196.
