Our reviewing court guides that the patentability of an apparatus claim "depends on the claimed structure, not on the use or purpose of that structure." Catalina Marketing Int'l. Inc. v. It is well settled that disclosure of a species may be sufficient written description for a later claimed genus including that species. Bilstad v. Wakalopulos, 386 F.3d 1116, 1124 (Fed. Cir. 2004). There are exceptions to this rule, however, namely when (1) there is unpredictability in performance of certain species other than those specifically enumerated, or (2) the specification makes clear that only the specific species is disclosed and nothing broader. Id. at 1125. Notably, in the latter case, the specification distinguished the prior art as inferior and touted the advantages of the particular disclosed species, namely conical shaped cups, which did not support claims to generic shapes.
