What the skilled artisan would "recognize" or have considered "obvious" is not necessarily determinative of "inheren[cy]." Schering Corp. v. Geneva Pharmaceuticals, 339 F. 3d 1373, 1377 (Fed. Cir. 2003). The Examiner appears to be conflating certain standards for demonstrating inherency with those for demonstrating obviousness. In relying upon the theory of inherency, the examiner must provide a basis in fact and/or technical reasoning to reasonably support the determination that the allegedly inherent characteristic necessarily flows from the teachings of the applied prior art. Analysis

We find that Appellant has the better argument. Taylor broadly mentions the use of a dry powder inhaler (Taylor p. 16,11. 26—35), Taylor is silent as to the structure of the inhaler. Thus, Taylor does not anticipate the pending claims.

The Examiner points to Islam as evidencing the structure of the standard dry powder inhalers referenced in Taylor. Ans. 6. While this may be true, Islam does not teach that all “standard dry powder inhalers” taught in Taylor to be devices for use with the disclosed xinafoate salt necessarily have a chamber that houses an active as an excipient free, dry powder, and an advancement mechanism capable of distributing the active ingredient to the chamber as required by the claim. Thus, the Examiner has failed to show that the claimed structure is “necessarily present.”

Appellants argue that the Examiner’s reliance upon Levy in an anticipation rejection is improper. Appeal Br. 6. However, under certain circumstances, an anticipation rejection over multiple references has been held to be proper, for example, to show that a characteristic not disclosed in the reference is inherent, as in the instant case. See Telemac Cellular Corp. v. Topp Telecom, Inc., 247 F.3d 1316, 1328, 58 USPQ2d 1545, 1553 (Fed. Cir. 2001)(“[R]ecourse to extrinsic evidence is proper to determine whether a feature, while not explicitly discussed, is necessarily present in a reference.”).1

Anticipation of a claim under 35 U.S.C. § 102 occurs when each claimed element and the claimed arrangement or combination of those elements is disclosed, inherently or expressly, by a single prior art reference. Therasense, Inc. v. Becton, Dickinson & Co., 593 F.3d 1325, 1332 (Fed. Cir. 2010).
