We are also not persuaded by Appellants’ argument that, the claims recite a process “previously done by a time consuming, laborious process involving multiple disparate applications” (Appeal Br. 35), because “the fact that the required calculations could be performed more efficiently via a computer does not materially alter the patent eligibility of the claimed subject matter.” FairWarning IP, LLC v. Iatric Systems, Inc., 839 F.3d 1089, 1098 (Fed. Cir. 2016), citing Bancorp Servs., LLC v. Sun Life Assurance Co. of Can. (U.S.), 687 F.3d 1266 (Fed. Cir. 2012). at 1278.

see also Bancorp Servs., L.L.C. v. Sun Life Assur. Co. of Canada (U.S.), 687 F.3d 1266, 1273—74 (Fed. Cir. 2012) (“[I]t will ordinarily be desirable—and often necessary—to resolve claim construction disputes prior to a § 101 analysis, for the determination of patent eligibility requires a full understanding of the basic character of the claimed subject matter.”)

For example, claim 1 recites a system that comprises “a data collector,” “a cross-modality response synthesizer,” and “a compressor.” There is no indication in the record before us that the Examiner has considered these limitations in light of the Specification in order to determine what claim 1 as a whole is “directed to.”

Claim 23 recites three means-plus-function limitations: “means for aligning,” “means for identifying,” and “means for transmitting.” Means-plus-function claim language must be construed in accordance with 35 U.S.C. § 112, paragraph 6, by “look[ing] to the specification and interpret[ing] that language in light of the corresponding structure, material, or acts described therein, and equivalents thereof, to the extent that the specification provides such disclosure.” In re Donaldson Co., 16 F.3d 1189, 1193 (Fed. Cir. 1994) (en banc). ...  There is no indication in the record that the required analysis was performed.

Simply using a computer to perform previously known processes will not transform an abstract idea into patent-eligible subject matter. See Bancorp Servs. LLC v. Sun Life Assurance Co. of Canada, 687 F.3d 1266, 1279 (Fed. Cir. 2012) (finding a claim not patent-eligible when “the computer simply performs more efficiently what could otherwise be accomplished manually”).

We find that claims 1–8, 11, and 13–25 are directed to a mathematical algorithm for calculating the modular inverse of a value, i.e., an abstract idea. The Supreme Court has recently reaffirmed that fundamental concepts, by themselves, are ineligible abstract ideas. Alice Corp. v. CLS Bank Int’l, 573 U.S. ___, No. 13-298, slip op. 1 at 10 (June 19, 2014). We recognize that independent claims 1, 14, and 18 conclude with an intended use clause “used for a cryptographic application” that applies the mathematical calculation steps to a specific application. A claim may be patent eligible if it includes additional inventive features such that the claim scope does not solely capture the abstract idea. Alice Corp., 573 U.S. ___, slip op. at 6. A claim reciting an abstract idea, however, does not become eligible “merely by adding the words ‘apply it.’” Bancorp Servs., LLC v. Sun Life Assurance Co. of Can. (U.S.), 687 F.3d 1266, 1276 (Fed. Cir. 2012).

Anticipation of a claim under 35 U.S.C. § 102 occurs when each claimed element and the claimed arrangement or combination of those elements is disclosed, inherently or expressly, by a single prior art reference. Therasense, Inc. v. Becton, Dickinson & Co., 593 F.3d 1325, 1332 (Fed. Cir. 2010). A reference inherently discloses an element of a claim “if that missing characteristic is necessarily present, or inherent, in the single anticipating reference.” Schering Corp. v. Geneva Pharms., 339 F.3d 1373,
1377 (Fed. Cir. 2003) (citation omitted) (emphasis added). “Inherency, however, may not be established by probabilities or possibilities. The mere fact that a certain thing may result from a given set of circumstances is not sufficient.” Therasense, 593 F.3d at 1332 (citing Cont'l Can Co. USA, Inc. v. Monsanto Co., 948 F.2d 1264,1269 (Fed. Cir. 1991)).

The prima facie burden has not been met and the rejection does not adhere to the minimal requirements of 35 U.S.C. § 132 “when a rejection is so uninformative that it prevents the applicant from recognizing and seeking to counter the grounds for rejection.” Chester v. In regard to the claims that recite the additional steps of computing, monitoring, signaling, notifying, etc., these steps relate to only ordinary functions of a computer and do not confer patent eligibility to the claims.

2887 LTS SCALE COMPANY, LLC Requester and Appellant v. ACME SCALE COMPANY INC. Patent Owner 95001401 7,757,946 11/108,271 WEINBERG 102/103 Barnes & Thornburg LLP (CH) THIRD PARTY REQUESTER: ECKERT SEAMANS CHERIN & MELLOTT, LLC TON, MY TRANG original LE, THIEN MINH

That is, the doctrine of claim differentiation creates a presumption that claim 9 does not contain the limitation of claim 22, as “’the presence of a dependent claim that adds a particular limitation raised a presumption that the limitation in question is not found in the independent claim.’” Bancorp Serv. V. Sun Life Assurance Co., 687 F.3d 1266, 1275 (Fed. Cir. 2012) (citation omitted). See also Liebel-Flarsheim Co. v. Medrad, Inc., 358 F.3d 898, 910 (Fed. Cir. 2004) (the doctrine of claim differentiation is at its strongest where Appellant wants to read a feature from a dependent claim into a term in an independent claim). The doctrine of claim differentiation therefore means that “material handling vehicle” in claim 9 is not limited to, and does not include, the fork lift, lift truck, flat bed, or pallet truck recited in claim 22.

Principally, Patent Owner relies on the Federal Circuit’s decision in ResQNet.com, Inc. v. Lansa, Inc., 594 F.3d 860, 865-66 (Fed. Cir. 2010), where the Court concluded that two user’s manuals for a software product were not printed publications. Relying on the Board’s informative decision Ex parte Ronald A. Katz Tech. Licensing L.P., 2011 WL 1676313 at *6 (BPAI May 2, 2011), Third Party Requester points to indicia of publication in the Tekelec documents themselves (copyright notice, references to the publisher) and to the fact that the documents reflect an on-the-market product. TPR Resp. 7-8. Requester distinguishes ResQNet in that the manuals in that case were not marked with any indicia of publication and one, in fact, purported to be “an unpublished work and is considered a trade secret…” Id. at 9 (quoting ResQNet.com, 594 F.3d at 865). Moreover, although not explicitly stated in the decision, the evidentiary standard in ResQNet was clear and convincing evidence; as noted by the Examiner the PTO standard is “preponderance of the evidence.”
